Danson Mungatana, that provided a framework for public appointments in the national Government. My concern is that Article 125 of the Constitution is an express granting of powers similar to those of the High Court of Kenya to the Houses of Parliament, namely, the Senate and the National Assembly. I am struggling to understand how an ordinary piece of legislation, because that is what this Bill is, can purport to transfer constitutional powers to another level of representation, in this case the county assembly. view

While I acknowledge the same, I do not see any reason why a statute would carry, word for word, the text in the Constitution. Whether it is unconstitutional or not, this is just bad draftsmanship. As I said in the beginning, it is important that county assemblies have a civil service that is professional, effective and has a level of certainty in terms of tenure. This law should be able to guarantee that.
