Hon. Temporary Deputy Chairlady, I beg to move:- THAT, Clause 14 of the Bill be deleted. The gist of this amendment is the same as in Clause 13. The function of boundaries should be left to the county governments as per the Fourth Schedule to the Constitution.

Hon. Temporary Deputy Speaker, I beg to move:- THAT, Clause 15 of the Bill be deleted. It is because it is not necessary to change the marginal note as it deals with the certificate of title as the conclusive evidence proprietorship. The amendment will guard against titles acquired unprocedurally through corrupt schemes. It will guard against protecting corrupt officers who issue titles un-procedurally; in a corrupt manner. We are safeguarding the sanctity of title deeds.

Hon. Temporary Deputy Chairlady, I beg to move:- THAT, Clause 16 of the Bill be amended— (a) by deleting paragraph (b); (b) in paragraph (c), by deleting the words “and substituting therefor the following”; (c) by deleting paragraph (d); and (d) by deleting paragraph (e).

The reason is that the matters listed as “overriding interest” should remain as they are because they qualify as overriding interest on land. Secondly, deleting “overriding interest” from the Land Registration Act will be in conflict with Article 63(2)(d) and 63(3) of the Constitution of Kenya.
