The reason we are deleting that clause and inserting this new clause is because the management committee is part and parcel of the structure of the community. view

What is likely to happen is that we are going to expose this community again to vagaries of nature which we were trying to cushion them from. So, the position is that if we throw them out there, it means that whatever we are trying to do in this Bill will be rendered nugatory. That is the reason. view

It is good that we debate this Bill from a very informative stance and knowledge of what the Constitution says and envisages to do with the functions of the two agencies, namely; the Ministry of Land, Housing and Urban Development and the NLC. These are the only agencies that are mandated to deal with land administration in this country. It is important to realise that the NLC and its functions are enshrined under Article 67of our Constitution. A number of them are listed there.
