  • 3 Dec 2020 in National Assembly: the ones that were raised this afternoon, and I can see even those petitioners have decided to go, will have to be reintroduced afresh. Hon. Speaker, for now, I am hoping the Members, the stakeholders of these Bills and petitions as it were, will have come before we close this Motion. The process was interfered with through these court cases that were brought by the other House and hence we were stopped from processing the Bills. Even some of the Bills that were are reintroducing today - I would have hoped Hon. Ichung’wah would ask a question and stay in ... view
  • 3 Dec 2020 in National Assembly: Thank you, Hon. Speaker. As I move this Motion, I would like to ask Members that it is important that they stay in the House. I beg to move the following Procedural Motion: THAT, notwithstanding the provisions of Standing Orders 41 and 42 relating to conveying of Messages from the Senate and from the President or the national Executive, Standing Orders 120, 122 and 126 relating to publication, procedure upon publication and First Reading of Bills, and Standing Order 210(2) relating to tabling of statutory instruments, this House orders that, during the period of the long recess (4th December 2020 ... view
  • 3 Dec 2020 in National Assembly: (iv) should the Speaker receive a Message relating to the Senate’s amendments to a Bill originating in the National Assembly, the Speaker shall forthwith refer the Schedule of the Senate amendments to the relevant committee for consideration pursuant to the provisions of Standing Order 145 (Senate amendments to Bills originating in the National Assembly), and, upon resumption of the House, report such fact to the House. This resolution was taken by the House Business Committee for recommendation to this House to help process business during the recess. This is so that all the business requiring a First Reading before it ... view
  • 3 Dec 2020 in National Assembly: Thank you, Hon speaker. Let me start by commending the Departmental Committee on Finance and Planning for the wonderful job they have done in considering this Double Taxation Agreement or the double taxation avoidance agreement between our great Republic and the Republic of Mauritius. It has been a long journey. It started in 2012 and was ratified, but then the ratification was challenged. At least, we are now doing it the right way. In between 2012 and now a lot of business opportunities have been lost because when you look at even from the United Nations Conference on Trade and ... view
  • 3 Dec 2020 in National Assembly: that environment for being a business hub that facilitates people to lease there, do business and access global finance from within Mauritius. Unfortunately, because of being in the two places people have been suffering the double taxation. So, you are taxed in Mauritius because you are registered there and you are also taxed in Kenya because you are doing business in Kenya. This agreement was meant to resolve that problem. There are several such agreements within the different countries such as the UK, US with several countries where there is voluminous business and investments flows between the two countries. So, ... view
  • 1 Dec 2020 in National Assembly: Hon. Speaker, I beg to move the following Procedural Motion: The electronic version of the Official Hansard Report is for information purposesonly. A certified version of this Report can be obtained from the Hansard Editor. view
  • 1 Dec 2020 in National Assembly: THAT, pursuant to the provisions of Standing Order 30(3)(a), this House orders that should the time appointed for adjournment of the House today be reached before conclusion of business appearing under Order No.12 on the Order Paper, the sitting of the House shall stand extended until the conclusion of the said business. As Members are aware, we have suffered some delay in the processing of Bills. Now that we have some agreement on some Bills that we could process, and we are going away this week, when we discussed this within the House Business Committee, it was the feeling of ... view
  • 1 Dec 2020 in National Assembly: Thank you, Hon. Speaker. Hon. Speaker, I beg to move the following Motion: - THAT, the Statute Law (Miscellaneous Amendment) Bill (National Assembly Bill No. 15 of 2020) be now read a Second Time. The Statute Law (Miscellaneous Amendment) Bill of 2020 was published on 3rd June, 2020, under the signature of my predecessor. This is in keeping with the practice of making various amendments to the various laws which ordinarily would not require separate Bills and then they are consolidated within one omnibus Bill. This Bill initially contained 35 or 36 old statutes, several of them have been removed, ... view
  • 1 Dec 2020 in National Assembly: In terms of Fire Arms Act, this is editorial. It is just to rename the Commissioner of Police as Inspector-General. The Official Secrets Act is also one of the other Bills being proposed. This is to define some of the terms including what data is and what telecommunication apparatus are. It is meant to harmonise it with modern technology. Production of data by a person who also controls any communication apparatus used for sending and receiving data to and from Kenya, is placed within the ambit of Official Secrets Act. On the Kenya Roads Board Act, the amendment seeks to ... view
  • 1 Dec 2020 in National Assembly: Provision under the Employment Act is meant to remove references to contributions of the National Housing Development Fund. It is also aimed at harmonising references to the Kenya Defence Forces Act and also to exclude the Coast Guard Service from its provisions. On the Accountants Act, we have had a discussion on this and basically, as you rightly stated Hon. Speaker, there is already a current provision in Section 17(2A) that the examination board requires one to be a Member of the institute. When you go to the Accountants Act itself, the member of the institute is assumed to be ... view
