I would like to inform my colleague that the Executive is still operating under the former Constitution. The powers of the President were saved and the particular paragraph that is relevant to this matter is under Section 24 of the former Constitution. It reads:- “Subject to this Constitution and any other law, the powers of constituting and abolishing offices for the Republic of Kenya; of making appointments to any such office and terminating any such appointment, shall vest in the President.” view

  • 17 May 2012 in National Assembly: Mr. Deputy Speaker, Sir, the clause that I did read--- Section 25(2) says:- “Office in the service of the Republic of Kenya means office in or membership of the Public Service, the Armed Forces, the National Youth Service and any other force or service established in the Republic of Kenya.” So, indeed, the entire public administration, all the people working under the Office of the President public administration are civil servants working within the public service and hence are covered within that framework. view
