Ordinarily, this is a policy on where refugees are supposed to be staying for only a short period of time. When the Somalia refugees came into the country in the 1990s, they were given sections of Dadaab where they were supposed to be staying. But because there is no proper control of designated areas, we have ended up with refugees intermarrying with local communities. The importance of this is to ensure that all the records concerning refugees that we have are intact. We must have a record of everyone who is admitted as a refugee. Clause 67, which is fairly important, speaks to the issue of legal aid. Article 59 of the Kenya Constitution agrees that every Kenyan, and everyone else who is in Kenya, is supposed to benefit from legal aid. I really think that you need to laud them for this particular legislation. The only thing I would like to say about it is that it is a legislation coming too late in the day. I think Members of County Assemblies (MCAs) should really appreciate that we are passing, at long last, a law that will give them a fund and money that can make them operate and not to be subservient and operate under the whims of county governors.   • 15 Nov 2016 in National Assembly: Clause 12 of this Bill speaks to the fact that the board is being given a chance to acquire, hold, charge and dispose of movable and immovable property. That is a good provision. We only need to safeguard it so that we guard against primitive accumulation. We also need to see how we are going to have transition between one board and the next so that the property and assets of various boards are not lost in the course of transition. We agree that the competition law ought to be one that promotes and safeguards the market as it is in consumer protection, and also helps with restrictive trade practises as well as monopoly.   • 13 Oct 2016 in National Assembly: I think that needs to be defined. There is an attempt in Clause 5 (2D) to say what “buyer power” would ordinarily mean. However, if we do not refine the prohibition in Clause 5 (2A), then I really think that the definition of “buyer power” which is contained in Clause 5 (2D) might not really be very useful.
