I sympathize with the situation of the Senator for West Pokot for he has people becoming bankrupt and it is the same thing in Mandera County or any other county because of the delay. This is an important Bill that reflects that the Senate has consistently ensured that revenues to county governments have been enhanced, on yearly basis, to ensure that the counties have adequate resources to deliver services. He has said that this Bill is about domesticating international law or convention. In the preamble, it says that this is an Act of Parliament to provide for the implementation of the UNESCO Convention. Therefore, we must be cautious that our interest is taken care of and we do not fall victims of those who think that performance, victory and being number one in the world is only a reserve of the developed countries. I think it would be wrong for the Members of this House to argue in any other manner other than the Committee to determine the constitutionality of this appointment. This company in six months – to September last year – has reported a loss of nearly Kshs12 billion. This company is still borrowing, even after the Kshs25 billion loss last year. Their total debt last year, when it had serious problems, was Kshs104 billion. By September, it had gone to Kshs115 billion.   • 19 Apr 2016 in Senate: Mr. Speaker, Sir, the conclusion by the Chair of the Committee is something that I find very unacceptable. I think it is unnecessary for the Committee to again invite the same governor to discuss the audit. The issue before this House is to invite those institutions like the EACC and others and to demand action to be taken on the recommendations that have already been made by the select committee and not to go through a whole process of trying to speak to the same Governor where the select committee of this House has already determined a wrong doing.   • 19 Apr 2016 in Senate: On a point of order, Mr. Speaker, Sir. You have heard the Chairperson say that his Committee has no powers to declare the governor unfit to hold public office. It is the practice in Parliament that where a select Committee has determined that a particular public officer has been involved in misappropriation or irregular procurement, it recommends that, that person is not fit to hold public office. Therefore, his Committee has the locus standi . It is, therefore, misleading to say that the Committee has no locus standi on that matter. view
