  • 28 May 2025 in Senate: Madam Temporary Speaker, I want to thank you for this chance. I want to confess from the beginning that this is not an easy debate. It is extremely complex because anything resulting in death is final. It marks the cessation of life that expresses itself through cessation of breathing, cessation of the heartbeat, and death of the brain. To debate this difficult subject, we must understand, as Parliament, what medical negligence is, because we are about to pass a serious verdict that Dr. Ondigo and the MTRH were negligent. Negligence involves a case where a healthcare provider fails to follow ... view
  • 28 May 2025 in Senate: The electronic version of the Senate Hansard Report is for information purposesonly. A certified version of this Report can be obtained from the Director, Hansard and AudioServices, Senate. view
  • 28 May 2025 in Senate: provide medical care using standard medical methods? That is what you should respond to. To do this, dear colleagues, to my professional mind, we must stick against six boxes. The first box is, was there misdiagnosis? Was Dr. Ondigo unable to establish the medical problem of the little girl? In this case, from this Report, no. Dr. Ondigo made the proper diagnosis of a foreign object in the pulmonary system. So, you cannot indict him on that score. The second one is, was there failure to treat? In this report, I have read it carefully, there was a lot of ... view
  • 27 May 2025 in Senate: Mr. Speaker, Sir, I rise pursuant to Standing Order No.53(1) to seek a Statement from the Standing Committee on Health on a matter of grave national concern regarding the employment of the staff of the Social Health Authority (SHA). The Secretary/CEO of the Public Service Commission (PSC), vide letter dated 21st November, 2024 and addressed to all individual former National Health Insurance Fund (NHIF) staff, required the said staff to acknowledge the receipt, immediately they got the letters and state whether they accept or reject the terms of their temporary deployment, something that caused a lot of anxiety, panic and ... view
  • 27 May 2025 in Senate: On a point of order, Mr. Speaker, Sir. view
  • 27 May 2025 in Senate: Mr. Speaker, Sir, I rise under Standing Order No.105. You heard the Senator of Kericho County accuse the employees of NHIF of approving claims for people who have been amputated five times. Is he in order to mislead the country, when it is a fact that you can amputate one limb even 10 times? This is important. People should not call Kenyans thieves when they do not have facts. For instance, this can happen in a case where a doctor is treating a patient who suffers from diabetes and the limb starts rotting. When the toes are rotten, you cut. ... view
  • 27 May 2025 in Senate: Thank you, Mr. Speaker, Sir. To suspend the Sitting of the Senate is an extraordinary issue and we are doing this to appeal to God. I, therefore, want your direction on this. Is it possible for all the luminaries of the United Democratic Alliance (UDA), who will be at the prayer meeting tomorrow, to find it in their hearts to forgive Gloria because God is a God of second chances? I say this because--- view
  • 27 May 2025 in Senate: Thank you, Mr. Temporary Speaker, Sir. I have two general comments. The first one is that we have to carry the country with us. There is so much arrogance amongst governors. They think that this money can just find its way in the county revenue fund without the legislation that we are doing right now. We want the people, to whom lies are sold by these governors, to hear what we are doing this afternoon. They should know that in the Financial Year 2024/2025, there was a balance when we shared money between the national Government and the county governments. ... view
  • 27 May 2025 in Senate: The second issue in this particular Bill that I want the members of the public to understand is the money, which is supposed to be given to counties. They are proceeds of payments made at our local courts. The members of the public should also know this Bill ensures that counties that mine various minerals get royalties through their governors. view
  • 27 May 2025 in Senate: Finally, but not least, this Bill ensures that the loans and grants from the World Bank, IDA (International Development Association), Financing Locally Led Climate Action (FLLoCA) and other international communities are now shared by the National Treasury with each county. That is the first general comment. Mr. Temporary Speaker, Sir, I must apologize because we want to pass this quickly because we have run out of time. We are not doing that because this Bill is not important. We are also doing that because governors and Members of the National Assembly have taken each other to court. We were forced ... view
