  • 28 Sep 2021 in National Assembly: particular function. Otherwise, when we leave it in generality, we are likely to have a blame game. We do not have anyone who is going to be critically responsible and accountable in case of any eventuality. I wish he could stick to the issue of specificity as opposed to generality. This is because when you talk of the county government, it could be the governor or the county secretary. How are we going to cure that? Thank you. view
  • 28 Sep 2021 in National Assembly: Thank you, Hon. Chairman. As you talk of Alliance, I went to a local school, Friend’s School Kamusinga, which I am proud of anyway. • 28 Sep 2021 in National Assembly: Whatever that takes, all of us are here. When you go to university, you find that the people who went to Alliance are behind and those who went to local schools are ahead. So, let us be proud of our backgrounds. That is on a light note. What Hon. Ichung’wah has said is very critical. For us to motivate the people who are not employed and the hustlers to contribute, it is important that we give the law a human face. In case of default, we need to find a way of harmonising if at all a person gives proper ... view
  • 28 Sep 2021 in National Assembly: Thank you, Hon. Temporary Deputy Chairman. As I rise to support, it is true that the two will complement each other. However, there is a concern. When it comes to matters of dialysis, the cost has been extremely high. Some of those inputs The electronic version of the Official Hansard Report is for information purposesonly. • 28 Sep 2021 in National Assembly: in dialysis have been subjected to taxation. I think at a later stage, we must go further and exempt the consumables under dialysis. I am happy the Chair of the Departmental Committee on Finance and National Planning, Hon. Gladys Wanga, is here because this has been a concern for many patients. Why do we exempt other issues, but when it comes to consumables under dialysis, they are subjected to taxation? I support, but we should do further amendments in the Finance Bill, so that the dialysis consumables are exempt from tax. I thank you. view
  • 1 Sep 2021 in National Assembly: Thank you very much, Hon. Speaker. I rise to support. I really wanted to talk to the issue of elections, but now that you have given me opportunity on the TSC matter, it does not matter. One of the critical things about TSC is that it is an independent commission established under Article 237 of the Constitution, with the critical function of human resource. It is involved with matters to do with registration, recruitment, transfer, promotion, discipline and firing teachers. This is a human resource function. When I look at the CVs of the nominees, I have no doubt that ... view
  • 1 Sep 2021 in National Assembly: As the Leader of the Majority Party has mentioned, one of the important expertise I want to point out is that of Sharon Chesire. I happen to have known her personally. On matters of human resource, she has been in the corporate world, including in the academia. I have no doubt she is going to be a critical expertise in human resource management. The critical function of TSC is human resource management. I have looked at the CVs of the other nominees and I can see they have done very well in education matters. So, in terms of matching the ... view
  • 1 Sep 2021 in National Assembly: Thank you, Hon. Speaker. First and foremost, I want thank Hon. Aden Duale for bringing up this matter. Indeed, this matter is fundamental. This is Parliament and our key role is to enact laws. We are here to legislate. Article 94 of the Constitution clearly stipulates that the legislative authority belongs to this House and not anywhere else. According to the principle of separation of powers, under the Arms of Government, Parliament is there to legislate while the Judiciary is there to interpret. They must be separated. There is no way Parliament can be gagged by the Judiciary and in ... view
  • 1 Sep 2021 in National Assembly: under this basic structure doctrine, and I found out that it is also not clear in academia and there are a lot of gaps. This is an area that PhD students in law need to research on. Having said that, I want to state that the matter that has been raised by Hon. Aden Duale is very key. There are Bills by Members of Parliament that have been processed and I want to state that this Parliament has very knowledgeable people as far as matters of the law are concerned. They should go through the pre-publication scrutiny and if the ... view
  • 1 Sep 2021 in National Assembly: This House must prioritise that. I am aware that Hon. (Dr.) Robert Pukose had brought a Bill on the issue of referendum. There was also a Committee Bill and I am aware that it was consolidated some time back, so that we can operationalise and understand how we can go about the issues of the referendum. When it comes to the issue of vetting signatures, how is it supposed to be done by the IEBC? There is no clear law that guides that. As a House, we should prioritise the referendum law. Hon. Speaker, when it comes to public participation, ... view
