  • 23 Jul 2019 in National Assembly: Not that, Hon. Temporary Deputy Speaker. I am happy the Chairman has tried, but we thought there should be a clause on review. Even if the clause talks about five years and yet we are talking about US$250,000, it is a drop in the ocean! Italians have really benefitted from this Agreement. When you go to Italy and tell them you come from Kenya, the first thing they talk about is Malindi. There are too many Italians who have settled in Malindi because of this project. In Italy, this project is under the Ministry of Education, Science and Research, but ... view
  • 2 Jul 2019 in National Assembly: Thank you, Hon. Temporary Deputy Chairlady. Article 115 of the Constitution is clear on presidential assent and referral. In this context, we are looking at presidential assent and referral, and the reservation the President has pertaining this Bill. We know well that in this country, the majority of the unemployed people The electronic version of the Official Hansard Report is for information purposes only. • 2 Jul 2019 in National Assembly: are youth. If this partnership will add value, the majority of the people who will benefit are the people of Coast region. It will not be the other people who are far. So, in this context, looking at the reservations, I am humbly requesting Members, because we know very well when you talk about Turkana oil, it is a national asset; when you talk of KWS, it is a national asset and when you talk about the ADC in Kitale, it is a national asset. So, in this context, I am humbly requesting our colleagues from the Coast; you are ... view
  • 26 Jun 2019 in National Assembly: Thank you, Hon. Deputy Speaker. First and foremost, I congratulate Mhe. Francis Waititu, the MP for Juja, for deciding to bring this Law of Contract (Amendment) Bill. The Bill deals with the issue of the guarantor and the borrower. We passed a law here on matrimonial property. As a spouse, you cannot sell family property without the spouse’s consent. That was the reason why many families were losing their homes. You will find one of the spouses has gone to a bank and taken a loan without informing the other spouse. When you guarantee somebody, you do not seek your ... view
  • 26 Jun 2019 in National Assembly: Many times, when colleagues want to take loans, we guarantee them because of the issue of reference. We do not even go further to know how much they are borrowing from the Sacco. I have been guaranteeing everybody. I do not even know how much they normally collect from the Parliamentary Savings and Credit Co-operative Society (Pacoso). It is because of the trust that we have in each other, but if we allow the person giving you money to come for you, the guarantor, without exhausting the assets of the borrower, it will be unfair. So, this Bill is very ... view
  • 26 Jun 2019 in National Assembly: borrowed. Borrowers have become sharper. They have even gone to an extent of conspiring with the people they borrowed money from. So, instead of the lender pursuing the borrower, he pursues the guarantor. Conspiracy has been going on. So, it becomes something that is very difficult. This law will protect guarantors. We know very well that for us to have a successful business and do business, we must borrow money. We know very well that people do not have start-up capital. Small and Medium Enterprises (SMEs) need start-up capital to do business. For them to get money, they have to ... view
  • 26 Jun 2019 in National Assembly: This Bill is very critical. It is going to protect the interests of families. It is going to protect the interest of SMEs. But do you want to tell those borrowers who want to harvest where they never sowed that they can do what the rule of terms does not say? In a SACCO, they normally say: “Save regularly, borrow wisely and pay promptly.” Those of you, who are borrowing money must put it into good use. I have seen people borrow money to go and marry many wives or many husbands, since we are nowadays also seeing women marrying. ... view
  • 25 Jun 2019 in National Assembly: Thank you, Hon. Chairman. This is a very serious matter because in any business, there is a risk and you want to mitigate against the risk. That is how insurance becomes very critical. view
  • 25 Jun 2019 in National Assembly: The brokerage insurance plays a critical role. In a situation whereby you are small investor, the insurer has no time to listen to you. Many times the broker is the one who will be your advocate. Some time back, I had an accident and because it was not a company, I was an individual, to get the money back; I had to use the broker to go and meet the insurer to advocate for me to get that money. When I tried to reach that person, he could not give me an audience. For brokers because of the scale of ... view
