When you read it at Clause 149, it will read like this; “the commission shall, in granting or rejecting an application for a license, take into consideration that the contractual rights privileges, liabilities and obligations accrued to an existing licensee or any other person are not materially, adversely affected.” That is what we are dealing with. view

Kajwang’ is asking is, in protecting the rights of the existing licensee as you license others, you are saying that there are rights, liabilities and obligations that should not be materially adversely affected. When you say ‘materially adversely affected’, you are creating a scope within which we will ask whether it is material or not material. It will be subject to all these kinds of interpretations. He is suggesting that it will be safer without the word ‘materially’ in there. Hon. Pukose wants to assist you, Hon. Chairman, before you finally have your say. view
