It is true that what happened with the recent Marriage Act was an amalgamation of several Acts of Parliament. I have had opportunity to practise law in this area as a lawyer and after the amalgamation of the Acts, it was not automatic that the regulations were also amalgamated. Therefore, there is need for regulations to be made under this new Act by the relevant body, which, in this case, is the Attorney-General’s Office. Again, the acquisition fee has to be checked under the regulations, so that the locality and what one has to go through is checked. The other issue that is raised here is that there have been inhibitions in registering marriages because of those challenges.   • 17 Jun 2015 in National Assembly: I agree with the proposal that all sub-counties should have a centre with an officer who will also conduct civil marriages, which can happen on any day of the week. Those officers should also be booked to visit areas where civil weddings are being conducted over the weekends. Therefore, this will make the law we have made much better. I therefore support.   • 3 Jun 2015 in National Assembly: Thank you, hon. Speaker for giving me an opportunity to contribute to the Division of Revenue Bill, 2015. Without repeating what my colleagues have said, I would like to state that part of the problem with money going to the counties is corruption. Corruption can be sorted out if we devolve the services of the EACC to the counties, so that the EACC has sufficient capacity to deal with matters relating to finances at the county level, where normal processes of government procurement and executing projects take place. At times these processes are tied up by the law. view
  • 3 Jun 2015 in National Assembly: We can deal with the issues of corruption at the counties. I support devolution and the money going to the counties. In counties where the governors have worked well, we have seen the effects of devolution and that it is a good thing. One of the worrying things about this Bill in the schedule is the Equalisation Fund, which has been allocated Kshs6 billion that has not been utilised at all since the inauguration of the new Constitution.   • 3 Jun 2015 in National Assembly: It would be fair that the Equalisation Fund is utilized, so that people who are suffering in some parts of the country, because there has not been equity since Independence, can be served and be like other Kenya. Finally, money allocated to Level 5 hospitals is justified. We need to improve on them so that services can be properly devolved. There should be, at least, one such hospital in every county to deal with new challenges such as cancer treatment. As we wait for you to make a ruling, I would like to state that ceilings are provided in the Budget Policy Statement (BPS), which we passed in this House; it is a property of the House. Therefore, the Budget now flows from the ceilings and there is no way any committee or Ministry can go beyond the ceilings.
