Even in parts of my constituency of Makueni, during the rainy seasons children spot stones on the riverbeds – stones which eventually turn out to be very precious minerals. Are we going to mine minerals only for them to benefit other people, and not ourselves? That aspect has generally been left out in the proposed law. It is, therefore, good for the Committee to look at it again, so that we can protect our resources. We should see what resources can come from our own National Treasury, so that we can exploit our minerals, just like is the case in Botswana. Minerals in Botswana were discovered by accident. In parts of Ukambani, including my constituency, there is serious drought and there are no signs that the national Government is about to supply relief food to schools. On a point of information, Hon. Deputy Speaker, I would like to seek clarification. Since this suspect was kept in custody for more than 24 hours, wass that in accordance with the Constitution? This suspect was taken to hospital for medication. Is that not an indication that there was a medical report and, therefore, somebody should be liable for assaulting the suspect? Thank you Madam Temporary Deputy Speaker for giving me this opportunity to contribute to this very important Bill and also congratulate hon. (Ms) Odhiambo-Mabona for bringing it to Parliament. As a practising advocate I have seen things happen in courts. The legal system we have in a lot of times recognizes a misadventure. Under the Criminal Procedure Code and the Penal Code, if you are killed by the police by accident it becomes a misadventure and after that your family is not compensated. In cases where people have sued having been victimized by the agents of State, their cases take many years to be completed; when they are completed, execution is a problem. It also takes years once there is judgment to be paid by the Attorney-General’s Office. Therefore, there is need to re-streamline this to take care of Kenyans who have been victimized in any manner by criminals, the State or any other organ. Their families, who are left behind or those who live with injuries, should be sufficiently compensated.
