  • 4 Jul 2018 in National Assembly: If a Kenyan is in another territory, they have a right to make arrests, but when a Kenyan is fishing and working on the Kenyan side and/or on Migingo Island, there is no reason at all to arrest these Kenyans and prosecute them for a non-existent offence in a foreign country or detaining them and eventually releasing them to go back home after torture and without any compensation, their time having been wasted. Therefore, the Cabinet Secretary overstepped his mandate by making these regulations which were already covered in other areas. It contravenes the Statutory Instruments Act. Therefore, the Committee annulled the regulations for those reasons. It is very clear in the Mining Act No. 12 of 2016. view
