  • 14 Oct 2015 in National Assembly: Hon. Speaker, I need your guidance. As you gave us direction as to how to continue debating this matter, you alluded to the fact that this is about the Waki Report and the Kriegler Report. That is what the Mover had said. You told us to stop bringing in the ICC issue into this debate. Is the Member in order to drag issues of the ICC into this debate? view
  • 14 Oct 2015 in National Assembly: Just like Hon. Gumbo, I support it. view
  • 14 Oct 2015 in National Assembly: Thank you, Hon. Temporary Deputy Chairman. I rise to support. This amendment is in line with the other Acts where we give powers of the police to other officers to be able to undertake their duties. I support. view
  • 13 Oct 2015 in National Assembly: Hon. Temporary Deputy Speaker, I am cognisant of the Standing Order where we are told not to repeat ourselves so much. I will try as much as I can to be done within three minutes. I stand to support this Bill. It has been said that it is going to avail justice in the fastest way. I remember when Hon. Keynan brought a Motion here in Parliament. He said that after our term in office we, as Members of Parliament, will not get employed. With this, we might get an opportunity to be adjudicators having had five years’ experience as ... view
  • 7 Oct 2015 in National Assembly: Thank you Hon. Speaker, for giving me this opportunity to give my contribution towards this very important legislation. Rightly, as you have just said, for example, where I come from, we have a High Court. But most of the cases that are supposed to be handled by it are not because it is so congested. Article 47 says that we need to have an expeditious process in the court in order to get justice. It is always said that justice delayed is justice denied. The problem that we have, like in Article 2, is that it gives an explanation of ... view
  • 7 Oct 2015 in National Assembly: courts in places that are gazetted and where members of the public can access them. In Nakuru, the municipal courts are located within the vicinity of the municipal premises and the authorities there close the gates. To some point, people were unable to access the courts. Some people had their bonds withdrawn because there were some riots which were going on, while the court was in session. Therefore, it is important for us to have the courts located in places as it is indicated in the Bill. The locations of the courts should be gazetted, and should be within the ... view
  • 7 Oct 2015 in National Assembly: are violated. An example is the fees that are charged at the High Court, which the common m wananchi may not afford. Article 10 of the Constitution talks about powers to punish somebody for contempt of court. Again, we need to be very careful. Article 10(d) relates to what we were looking at just the other day at the International Criminal Court (ICC) regarding a witness who has refused to testify, one who has recanted his evidence or has said that he does not want to attend the proceedings. The ICC did not have a procedure for dealing with such ... view
  • 7 Oct 2015 in National Assembly: Hon. Temporary Deputy Chairman, I was enquiring something from Hon. Sakaja and he has already explained it. I shared the same view with Hon. Manje, but I sought some clarification from the Chairman. I am sorry it was Hon. Sakaja. He has actually explained this to me exhaustively. view
  • 7 Oct 2015 in National Assembly: Hon. Temporary Deputy Chairman, I have corrected that. view
  • 7 Oct 2015 in National Assembly: Thank you, Hon. Temporary Deputy Chairman. As much as I support the Bill, I also rise to support what Hon. Wanga has just said. The original Bill had given an indication of the youth. Paragraphs (g), (h) and (i) had actually said “a youth”. It is worrying that the Committee, as it is now with the amendment by Hon. Were, might not have even a single youth in there. Much as we are talking about the youth and what Dr. Nyikal had earlier said, let us not lose the focus of the intention of the Bill to have the representation ... view
