  • 27 Aug 2014 in National Assembly: Yes, hon. Chairlady. I seem to agree with what hon. Ochieng is saying. But sub-clause (c) says that it goes to the victims services agency but at the same time it is saying here that it is the investigating officer with other agencies in a manner prescribed in this law. I do not see any contradiction because the investigating officer will go to that agency and be able to give it. I mean there must be somebody who will write the statement. So, even if it is the victims services agency, I do not see any contradiction because there must ... view
  • 27 Aug 2014 in National Assembly: Maybe the Chair can clarify on page 373, Clause 10A(d), “to cope with problems associated with victimization.” He has already specified some of them, such as injury, emotional trauma, access and participating in criminal justice process and participating in restorative justice. I hope the problems associated with victimization will not form part of where we will use this system to bribe the people who are concerned; to give bribes to the victims, for example, and say: “I cannot work now. I need you to maintain me for the coming two to three years or within the period of the trial.” ... view
  • 27 Aug 2014 in National Assembly: On a point of order, hon. Temporary Deputy Chairman. I am just seeking your indulgence as hon. Makali had said. If we defeat an amendment by the Chairman, then where do we go? We thought hon. Makali was right to seek your guidance, because we might have cases as we go along. So, should we go back to that without knowing the position after we defeat an amendment? If we defeat an amendment, then it means that we revert to the original clause. That is why hon. Makali was asking you to give direction. We know that if we defeat ... view

  • 27 Aug 2014 in National Assembly: Thank you, hon. Temporary Deputy Chairman. I support the Chairman with regard to the institutions that have been mentioned here. I think they play a very big role in terms of economic development within the country. Their exemption from paying tax is a welcome idea and I totally agree with the Chairman. view
  • 27 Aug 2014 in National Assembly: Organizations like the United Nations (UN) offer many functions that go a long way in the development of this country. This is especially in very remote areas. This will go a long way to assist and encourage those organizations to continue with their very good and noble work. view

  • 21 Aug 2014 in National Assembly: Thank you, hon. Speaker, for giving me the opportunity to contribute to this debate. I do not know whether to support the Bill or not, based on what I have seen happen within my constituency. I think this is a good Bill. We, as Africans, are always regarded as a dark continent, full of diseases, wars, fighting and things like that. The enactment of this Bill into law will change the perceptions of the international community about Kenya. This shows how advanced we are, as a country, and how we have changed in the recent past, to be able to ... view
  • 21 Aug 2014 in National Assembly: Hon. Speaker, I also want to refer to Section 23 which talks about a respondent who is arrested under sub-section 2 of Section 23. The respondent shall be held in The electronic version of the Official Hansard Report is for information purposesonly. A certified version of this Report can be obtained from the Hansard Editor. view
  • 21 Aug 2014 in National Assembly: custody and brought before a court as soon as possible; and in any event not less than 24 hours after the arrest. Of course, I know that has been addressed somewhere else in other laws, but of course it not taking into consideration weekends. If it says 24 hours, of course, it does not take into consideration weekends and public holidays. If you look at this section as it is, it indicates that within 24 hours the suspect is supposed to be arraigned in court and yet it could be on a weekend. view
