Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT, Clause 32 of the Bill be amended by deleting paragraph (a), and substituting therefor the following- (a) may, despite Section 41, dismiss a county executive committee member at any time, if the governor considers that it is appropriate or necessary to do so; The import of this is that just like the President, the governor should be allowed to dismiss his cabinet without giving any reasons.

Mr. Temporary Deputy Chairman, Sir, if we are truly mirroring the national government against the county government, we do not need to set different rules. At the national level, you cannot tell the President that if he has to fire a Cabinet Secretary, he has to prove incompetence or any of those grounds. That is because those members of the Cabinet can go to court and say that they cannot be fired. The governor is supposed to be a responsible person. Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT, Clause 34 of the Bill be amended by deleting subclauses (2),(3),(4),(5),(6),(7), (8) and substituting therefor the following new subclauses- (2) If a motion under clause (1) is supported by at least two-thirds of all the members of the County Assemblyâ (a) the Speaker of the County Assembly shall inform the Speaker of the Senate of that resolution within two days; and (b) the Governor shall continue to perform the functions of the office pending the outcome of the proceedings required by this section. Mr. Temporary Deputy Chairman, I beg to move:- THAT, Clause 56 be amended in sub clause (1)- (a) in paragraph (a) by inserting the words ânominated and appointed by the county governor with the approval of the County Assembly immediately after the word âchairpersonâ; (b) by deleting paragraph (b). The justification of this is to incorporate the manner of appointment of the chairperson which had been left out. It also removes the repetition of the procedure of the election of the vice-chair as provided in sub-clause 6.
