On a point of order, Mr. Speaker, Sir. I think time and again you have asked the Executive to operate on the basis of collective responsibility. On a matter of such magnitude and of national interest, the Assistant Minister for Lands cannot just come here, and as part of the answer to this House, say that a matter is not for him but is for another entity. Are you satisfied that the Assistant Minister is taking this House seriously?

Mr. Speaker, Sir, I also rise to support this Motion. I am supporting this Motion in a qualified manner. First, it took the Speaker himself at the workshop in Mombasa to let the country know that the Executive was sleeping on the job because it had yet to petition Parliament. This House, particularly this side, heard you and we petitioned Parliament as provided for in terms of signatures from the Members. I want to thank the Members who appended their signatures. Mr. Speaker, Sir, that is why we support you as a House. The Deputy Leader of Government Business, apparently, does not listen to his boss. The boss, namely, the Vice-President and Minister for Home Affairs and the Leader of Government Business, when proposing the Procedural Motion stated very well that he has now decided to drop those other Orders because he knew the House will be against that and I am responding to the preposition. I am completely in order.

Mr. Speaker, Sir, more importantly, I wanted to make the point that devolution is the heart of the Constitution. The thinking as expressed by the Orders here is what we are faulting. That initial thinking, in the first place, should not have been entertained because it means, one, Parliament’s role is negated and two, the Constitution which promotes public participation in whatever we do, is not adhered to. On a point of order, Mr. Temporary Deputy Speaker, Sir. The rules of this House are very clear. It is only during Ministerial Statements that Members seek clarifications and the Ministers respond. This is a Report and the Chairman has already moved it. He has exhausted his portion of the contribution and, therefore, is speaking twice to the same Motion. Is he in order?

On a point of order, Mr. Temporary Deputy Speaker, Sir. I want to thank you for bringing this to my attention. Indeed, it is talking about being misunderstood. Mrs. Shebesh asked for clarifications. Secondly, the same Standing Order No.74 (2) also says that:- “The mover of a substantive Motion may surrender all or part of his or her right to reply to another Member---” So, all I was asking is: It is possible for the Chair to delegate to the rest of the Members of the Committee? He is not alone in the Committee.

Thank you, Mr. Temporary Deputy Speaker, Sir. I applaud your wisdom in delaying my contribution until the amendment has been moved because I want to support it. First, I want to congratulate the Chair and the Committee for a good job and for taking the trouble of ensuring that the names that came before them were vetted. They were just a bit shy about the name of Mr. Isaiah Kubai. There is a good reason and I know that the Committee wanted a fair opportunity for everybody.
