Mr. Speaker, Sir, first, on my own behalf and on behalf of the people of the great County of Nyamira, I want to send a message of quick recovery to His Excellency the Deputy President Rigathi. We wish him a speedy recovery. The Bible says in the book of Ecclesiastes 3:1 that there is a season for everything. There is a season to be born politically and a season to die politically. That is biblical. I have agonized and gone through a lot of soul searching as I listened to the evidence that was tendered, against---

As a lawyer and a person who witnessed the birth of the 2010 Constitution, I strongly believe that Kenya belongs to all the 42 plus tribes. What has disturbed me for the two days I have sat here is this: What will happen to my community in Kisii and Nyamira if we ran our Government through this theory of shareholding? As I speak tonight, the people of the two counties of Omogusii; Nyamira and Kisii are victims of that theory of shareholding. That community called Omogusii does not even have even a single Principal Secretary serving in the Government. As ...

Why did they not swear an affidavit? That has troubled me a lot. As I cast my vote tonight, I will be casting my vote for those children who lost their mother, who lost their father, but who were not given an opportunity to appear before this House and tell us that there has not been any wrongdoing from the Deputy President to those children. Count No.1 and Count No.8, is about the utterances that were made by the Deputy President. I hope that the person who will occupy that coveted position of the Deputy President will reflect on what ...

Thank you, Mr. Speaker, Sir. I want to seek clarification on what is on page 15, paragraph 41. There is the allegation being made that in the past two years, H.E the Deputy President has amassed a humongous property portfolio, estimated at Kshs5.2 billion. I was trying to follow your answers during cross-examination and I do not know whether you were trying to drop this allegation or if you want to still maintain it. I want you to give a proper clarification that links the person against whom you have brought the Motion that is the Deputy President, with that ...

Thank you, Mr. Temporary Speaker, Sir. We are facing a very bad crisis. This afternoon a Senate of the Republic of Kenya is discussing a conduct of a governor who has refused to respond to summons issued by the Senate. Even in the most advanced democracies, you can never refuse to respond to summons of a House, more so a Senate. If you look at history, you will know what brought down President Richard Nixon. He was given summons by the Senate that was looking into his impeachment. The Senate ordered him to produce tapes that had some information on ...

Mr. Speaker, Sir, I fully understand and symphathise with the agony that hon. Senators are finding themselves in while trying to get the pagination. I also symphathise with the counsel. He has made eight bound copies for 67 Senators. The copy I have is well paginated. He was making reference to pages 386 and 387, which seem to have a properly paginated bundle, which my colleague, Sen. Wambua, has paginated, which reads 374 and 375. This is not an easy task. I plead that for those of us who have the right copies; it is easy to make reference to ...

Mr. Speaker, Sir, it is not easy to prepare all these bound documents. Let us know which Senators do not have the right copies. As I said, the one I have is well paginated. The ones who do not have the bundle that is not well paginated can draw the attention of the clerk, then they can swap, or the counsel can supply another copy. It seems some of us have well-paginated documents while others do not.

Okay, under the Third Schedule, under the Rules of Procedure. My understanding is the moment an impeachment lands on the Floor of the Senate, it becomes the property of the jury, who are the Senators. If these proceedings were being conducted by a special committee of 11 members, you would never be invited to make a determination on the issue of whether a two-thirds was reached. That decision would be made by that committee of 11 members. By extension also, the right person or persons to make a determination as to whether the threshold of two-thirds was reached during impeachment, ...
