There have been delays in clearing cases. The fact that there are 650 cases pending is unacceptable. These delays to deliver justice cause a lot of suffering. We know of the case of the family of the late Mbiu Koinange that took 35 years to settle. There are many similar cases where Kenyans have waited for justice for far too long. This Bill seeks to do away with outdated laws that govern the administration of justice. If we do away with those laws, Kenyans will receive justice. There is a lot of wastage of resources by the Judiciary. You remember that in the last Budget, we had to cut their Budget because there was too much and the absorption rate was low. I have also learnt that there is lack of usage of Information Technology (IT) by the judicial staff. This is one of the bottlenecks that this Bill has not addressed adequately. People and organisations have embraced IT. Apart from the Judiciary and the Ministry of Lands, most of the other Government Departments have embraced IT. The first place to have embraced IT should have been the Judiciary, so that they can deliver justice. Lastly, disregard for court rulings by State agencies breeds lawlessness.
