Mr. Deputy Speaker, Sir, I cannot order for the loose chippings to be removed because they are part and parcel of road construction. They are supposed to provide grip on the tarmac when they are wiped out of the road. So, I cannot, in any way, order for those chippings to be removed because over time, we expect them to be removed. What we want is motorists to stop over-speeding.

Mr. Temporary Deputy Chairman, Sir, I support the new Clause, only that I want some clarification on Clause 34B(7) which says:- “A person who is suspended under this Section shall continue while on suspension to receive half salary and other remunerations.” I am aware of so many civil servants who are on suspension and they seem to be on suspension until Jesus comes back. I hope there is a time limitation on the suspension.

Mr. Temporary Deputy Chairman, Sir, on “d” I agree with the proposal by Ms. Karua, which has been supported by the Minister for Justice, National Cohesion and Constitutional Affairs. I think there is a typing error under “d”; where it says “22”, I think it is “rules for mergers included”. I hope the Chair of the Committee is listening.

Mr. Speaker, Sir, I am sorry for responding to your call late. I beg your indulgence. I beg to reply. (a) The construction of Kirigiti-Kibichoi Road (C64) was not abandoned, but was wound up after the contract sum was exhausted. This was occasioned by an increase in the scope of works especially the volume of earthworks that had not been anticipated during the design stage. (b) The Ministry has plans to execute the remaining works in the Financial Year 2012/2013.

Mr. Speaker, Sir, I want to reiterate that the money that was set aside was outstripped by what was unforeseen in form of earth works. We had to remove and shift a lot of earth, and this took a lot of money. The effect of that unforeseen expenditure is the undone five kilometres of the road. We estimate the construction of those five kilometres to cost Kshs350 million. I would like to give the hon. Member an undertaking that works on that road will commence again in the year 2012. Mr. Speaker, Sir, that is the situation I have been battling with since I got to the Ministry, where I found that the design works do not disclose the nature of the materials or the nature of the conditions where we are to traverse. So, I have since changed the rules completely for road designers to face the consequences of such omissions. Indeed, the particular designer involved in this case is being disciplined for not being careful and not disclosing all the details.
