Mr. Deputy Speaker, Sir, I wish to thank the Chairman for the response but I am disappointed by the response that he has given. It is extremely inadequate and does not respond to the issues that I had sought in my Statement. Clearly, even after none other than His Excellency himself was on national television giving assurance that all public schools will have been issued with title deeds by the last day of March, which is just a few days from today- this was a deadline that he imposed on himself and the Government- nothing has been done since then. ...

On a point of order, Mr. Temporary Speaker, Sir. I do not know whether you are satisfied that the Chairperson should continue answering because I am not. He has been unable to answer the first and the most basic question that I asked him; to provide a list of schools in Kenya and the status of the title deeds. I had a reason to ask this question. On a point of order, Mr. Deputy Speaker, Sir. As you correctly pointed out, my first question was in two bits; the list of all public schools which he says he is unable to obtain but I also requested for the status. The Chairperson has said that he can only have information about schools that have applied for title deeds or those which have already been issued with. Then he goes on to give us the applicants who are 5,319. He says out of that only 345 have been issued with titles. I believe these are the new applicants. So, ...

Mr. Deputy Speaker, Sir, the point Sen. (Dr.) Khalwale is raising is constitutional. We, as a House, should take it more seriously than we are. If the “lower” House has breached our Constitution then we should not join them in doing so. As the “upper” House we will uphold the Constitution and its provisions. Sen. Madam Temporary Speaker, I know the questioner says that she is satisfied with the answer. However, let me make it clear that the Chairperson says that the Government has made it mandatory for Safaricom Ltd and Airtel to extend their services to those areas. Safaricom Ltd and Airtel are business enterprises and the reason they are not extending service to that area even if you force them, is because it is not profitable. We expected that this statement would be issued today because it was on the Order Paper yesterday. The Chairperson was here, ready with the answer, but we requested for time to interrogate the written reply and that it be issued today.
