Mr. Speaker, Sir, I rise to support the statement by Sen. (Dr.) Khalwale. Let me start by saying that every Kenyan has the right to run for any position in this country. Sen. Wetangula was within his right to go and launch his presidential bid and he cannot be an exception. There is freedom of movement and association as enshrined in our Constitution. Mr. Speaker, Sir, the points of order raised by my colleagues just go further to support my point; that thorough investigations must be done to establish where this teargas was obtained from. Some of us know that teargas is a preserve of anti- riot police, therefore, the common mwananchi cannot access them. On a point of order. Mr. Temporary Speaker, Sir, may I pick up from where Sen. (Dr.) Khalwale left. The Chair heard Sen. Elachi saying that we are all thieves. That is imputing improper motive on some of us who are not thieves. She confessed that she is a thief and she knows who else is a thief. Therefore, she should not include us in a list of thieves. Is she in order to imply that we are all thieves?

Mr. Speaker, Sir, I am not a Member of the Committee; I am the one who sought the Statement. This Statement has been appearing on the Order Paper continuously for the last six weeks since we started this session. On several occasions, the Speaker has given firm instructions that the Statement should be answered the following week. I even requested that the Speaker should give some sanctions because I thought the Chairman of this particular Committee is not taking this matter seriously. Mr. Speaker, Sir, I have a strong feeling that the chairman is not taking this matter seriously. On three occasions, he was in the House. When we got to Statement Time, he walked out. Mr. Speaker, Sir, I wanted to ask exactly what Sen. Okong’o has asked. After the very lengthy ruling or Communication that you made, you have ruled that the Senate will consider the Physical Planning Bill (2015) at an appropriate date. This Bill was processed through the National Assembly without observing the provisions of Article 110(3) of the Constitution. You have ruled that Article 110(3) of the Constitution cannot be applied retrospectively. We seek your clarification. In our opinion, the Senate should not consider this Bill at all.

Mr. Deputy Speaker, Sir, I register my complaint to the Chairperson that Statements (g) and (i) which I sought from the Chairperson of the Standing Committee on Finance, Commerce and Budget, have been on the Order Paper for the last four weeks. Mr. Deputy Speaker, Sir, I remember that last week you gave an order that the Chairperson of the Committee on Finance, Commerce and Budget comes to respond to this Statement and before he responds he should apologise because he had been in the House but when we got to statements he deliberately walked away---

Mr. Deputy Speaker, Sir, the Chairman of the Committee on Finance, Commerce and Budget deliberately walked away. He has done the same thing today. He was here a little while ago and when we got to the order of statements, he walked out. He is not treating this House seriously; some sanctions must be given to him.
