However, one fundamental thing that this House must address itself to is whether Article 125 refers to certain Kenyans and not others. If the drafters of the Constitution wanted to exclude anybody from the provisions of Article 125, they would have excluded the Speaker of the National Assembly, the Speaker of the Senate and the CJ.   • 12 Nov 2015 in National Assembly: The Chair of JSC is like the Chair of any other constitutional commission. If we invite those other chairs, how can we fail to invite the chair of the JSC? We give taxpayer’s money to the JSC to spend and they must account for it. If in the process of accounting for that money, the CJ has to appear before the House as the chair of the JSC, let it be. This time round, I will be watching to ensure that those mood swings I see at home are not related to those other things. I want to take this opportunity to sympathise with the retired Major for falling sick during his tenure as a Commissioner. The Constitution creates the NPSC and gives it specific duties to carry out.   • 28 Oct 2015 in National Assembly: However, I do not want to let this Commission off the hook. They have been in office since 2013 and they knew that there had been a vacancy. They knew that a member of the Commission had died but they did not see why that person, who was the Vice-Chairperson of that Commission, should be replaced. It would be immoral to pile pressure on a Commissioner who is sick instead of replacing a Commissioner who is already dead. It sounds immoral. Article 47 of the Constitution provides that every action carried out by an administrator, or anybody given discretion to decide, must be fair. Outlining a process through which the discretion of the commissioner will be exercised enriches the Act. With those remarks, I beg to support. view

  • 6 Aug 2015 in National Assembly: Thank you, Hon. Temporary Deputy Chairman. I support the amendment. As we speak, we do not have the Insolvency Act, 2015. So, passing a law that creates an impression that the law exists would be a mistake. This is a neater way of presenting it. I support. view
