  • 2 Dec 2021 in National Assembly: It is there. Article 24(3) is the answer to the provision for limitations of rights. The electronic version of the Official Hansard Report is for information purposesonly. A certified version of this Report can be obtained from the Hansard Editor. view
  • 2 Dec 2021 in National Assembly: It says that the State or a person seeking to justify a particular limitation shall demonstrate to the court, tribunal or other authority that the requirements of this Article have been complied with. The point I am making is that, if you fear, there may be a violation of the right to fair trial, make an amendment to the specific clause which is not mentioned here and we will delete it at the Committee stage. However, do not torpedo debate by the people. When we had the NYS issues in the country, how many lawyers were mentioned and how did ... view
  • 2 Dec 2021 in National Assembly: started, people would come and while you are still negotiating, they were offering Kshs18 million. They ran to Kshs30 million. They are walking towards Kshs60 million. Those are piracy monies from Somalia did not just come and land here. They came through advocates' accounts and you know those advocates. Let us not pretend. Therefore, we may take it for granted that this money- laundering thing is overturning our entire economy and making dirty our business environment. Hon. Temporary Deputy Speaker, I urge you to rule against this Bill for one, it is unconstitutional. Nothing has been clearly demonstrated. Secondly, the ... view
  • 2 Dec 2021 in National Assembly: Hon. Temporary Deputy Speaker, it is very difficult to speak after the Leader of the Majority Party. A short while ago, he got a PhD on matters finance. So, he understands this matter deeply. Most of the matters I wanted to address have been canvassed during the ‘constitutional issues’ debate and, so, I will not take much time. Allow me to mention two issues so that I allow other Members to contribute. When the Westgate attack happened, among the soldiers who were directed to intervene was Jacktone Puodi from Katuma Village in Kanyada. That is my village. We cried with ... view
  • 2 Dec 2021 in National Assembly: you when we were burying Philip Puodi that he was a boy I educated at Wiobiero Primary School. It is painful. Without saying much, I want to request fellow Members: We are not an island as a country. There are international conventions. Let us not exclude ourselves from the global community by seeking cover under some amorphous things like advocate-client confidentiality. Advocate-client confidentiality is a good thing, but it can be limited. And it is not a constitutional issue. Reasons for limitation are well explained in the Bill. If there are grounds for improvement, that will be done at the ... view
  • 2 Dec 2021 in National Assembly: Oh! Hon. Millie is also there. Let me confirm that only lawyers who see the sense in supporting this Bill have remained. I do not want to say much. I support and second. I thank you very much. view
  • 23 Nov 2021 in National Assembly: Thank you, Hon. Temporary Deputy Chairman. Should I say that it be approved? view
  • 23 Nov 2021 in National Assembly: Thank you, Hon. Temporary Deputy Chairman. I beg to move that Senate amendment to clause 6 be approved by the House. Essentially, we had made an amendment to remove the Principal Secretary for the State Department for Infrastructure from the membership of the Privatisation of the Committee. The reason was that several projects may be involved. They could be water or energy projects. We thought the Principal Secretaries should be co-opted on a need basis. But the Senate disagreed and said we should include the one in charge of infrastructure, probably because most PPPs are infrastructure related. So, we agree ... view
  • 16 Nov 2021 in National Assembly: Thank you, Hon. Temporary Deputy Speaker. On behalf of the Constitutional Implementation Oversight Committee, allow me to take this first chance to thank all Members who have contributed, both in support and in opposition. I have listened keenly, even the times I was away from the House, to the contributions by Members and they have all been gratifying. We have groups within our society who, for the first time, the Constitution singled out in terms of specialised treatment on human rights matters. These are the children whom Hon. Millie has been very passionate about, and we thank her for it. ... view
  • 16 Nov 2021 in National Assembly: you know it, in addition to the youth commission you were creating, children will also seek their commission. I need to alert the Members that in the long run, you will be creating commissions for all the special groups in our society. There will be duplicity in the sense that the limit and remit of their mandate will be about the human right issues affecting those sections. Let us establish the Kenya National Commission on Human Rights and Equality Commission, as already established in the Constitution, then, we can have sections or departments directed and targeting these specialised groups, so ... view
