Mr. Speaker, Sir, the Kshs4 million has already been shared between the farmers and the millers. I can assure Mr. Washiali that if there is a case like that of cane being confiscated and it does not belong to a certain contracted farmer; it belongs to a private one and he has all the documentation, that should be passed to the Ministry and we will take appropriate action.

Mr. Temporary Deputy Speaker, Sir, by the time we were preparing this Statement, the Committee had not tabled their report. This request of the hon. Member was done on 31st May. I have been coming with this Statement on a daily basis and not getting an opportunity to issue this Statement. As I speak, I have not even seen the Report by the Chairman of Departmental Committee on Agriculture, Livestock and Cooperatives. So, I do not know what they have tabled.

Mr. Speaker, Sir, I beg to reply. (a) MOCO has taken Mumias Sugar Company to court on the matter; the whereabouts of Kshs6 per tonne capital levy paid by Mumias Sugar-cane farmers. Hence, it will be prejudicial for me to give any further information. (b) Between 1975 to 1998, a total sum of Kshs288,117,285 was deducted by MOCO as sugar-cane levy from farmers between commencement and stoppage time.

Mr. Speaker, Sir, the case, the hon. Member is talking about is at Kakamega High Court. I am talking of a case in Kisumu High Court whereby MOCO took Mumias Sugar Company to court challenging the Sugar Company to pay them capital levy. The case was moved, when Mumias Sugar Company went to Kakamega and sued MOCO to stop it, so that they could continue with the process of arbitration. So, there are two cases.
