(b) subsection (2). Hon. Temporary Deputy Chairman, we are trying to come up with a law on recruitment of staff. The law was saying that the CS shall in consultation with the DG appoint staff of the directorate. We felt that this should be left to the Public Service Commission. Temporary Deputy Chairman, I beg to move: THAT, the Bill be amended in Clause 19 by: (a) deleting paragraph (c) appearing in subsection (1) and substituting therefor the following new paragraphs- (c)guiding and advising contracting authorities in project structuring, procurement and tender evaluations; (ca) leading contracting authorities in contract negotiations and deal closure; (b) inserting the following subsection immediately after subsection (2) (2A) The Directorate shall issue standard bidding documents for use by contracting authorities. view

Part (c) states as follows, “leading contracting authorities in project structuring, procurement, tender evaluations, contract negotiations and deal closure”. For example, having KeNHA as a negotiating authority. There must be clarity on who conducts procurement. The deletion we are making is to say that the Directorate at PPP, which is at the National Treasury, will guide and advise contracting authorities in project structuring, procurement and tender evaluations, so that their role is only related to guiding.
