Hon. Temporary Deputy Chairman, finally, we have various forms of business entities, including businesses owned by individuals, companies and co-operatives. A tribe cannot be any form of business associations. Once we pass this Bill, we shall be bestowing legal responsibility upon amorphous entities.

I support because I have no alternative but, in my opinion, the philosophy of a community land is fake. Why? One, you cannot take it to the bank. Two, we are becoming modernised. When we become modernised, it means that property can only be invested in a legal entity, for instance, a cooperative, partnership, company or an individual. You cannot transact business in form of a community. ‘Community’ is an amorphous term. This is a very bad philosophy. Thank you, Hon. Temporary Deputy Speaker. I rise to support the recommendation of the Committee. I believe, from a legal point of view, the plain reading of that section of the Constitution is very clear. That section vests jurisdiction of transfer of functions on this entity called TA. It is true, and I agree that, that section does not expressly bar an extension of term. But if you were to argue from that point of view, we shall be raising a dangerous precedent. Thank you, Hon. Temporary Deputy Chairlady. I support this amendment. Between an employee of the Board and the CDFC, who can you trust as a Member of Parliament? All factors being constant, you would trust the CDFC more than a person who comes from Nairobi.

Hon. Temporary Deputy Chairlady, I beg to move:- THAT Clause 22 of the Bill be amended by inserting the following new paragraph immediately after paragraph (b)— “(c) include any other project undertaken pursuant to Article 187 of the Constitution.” The import of my amendment is, if we pass this law as proposed by the Chairman without these amendments, it will mean that Hon. Members will never construct a road, bridges or start a water project. However, that is against Article 187 of the Constitution which is about transfer of functions. One, the document that I obtained from the Legal Counsel of the National Assembly was that my amendments do not touch on the county functions at all. It was there in black and white. Therefore, this amendment does not mention counties at all. Finally, as you can see the way I have framed it, I have said: “To include any other project undertaken pursuant to Article 187 of the Constitution.” I have not added any other thing. I have not mentioned counties.

Hon. Temporary Deputy Chairlady, I beg to move:- THAT, clause 34 of the Bill be amended by inserting the following new sub-clause immediately after sub-clause (1)— “(1A) No project shall commence without public presentation of the project’s cheque to the project management committee by any member of the Constituency Committee in the presence of the member representing the constituency in the National Assembly”. “(1B) The tenure of members of the project management committees shall terminate at the end of every project”.
