  • 5 Mar 2020 in Senate: Thank you, Madam Temporary Speaker. I take this opportunity to support the Statement by the Chairperson of the Senate Committee on Justice, Legal Affairs and Human Rights. This is an important Report that has been prepared by the Committee to which I am a Member. The reasons I stand to support are, first, Article 2(5) the Kenya Constitution, 2010 provides that international law shall form part of the Kenyan law.   • 5 Mar 2020 in Senate: Madam Temporary Speaker, when you look at the facts surrounding this matter, you see a situation where a poor boda boda rider and a good Samaritan was killed by a police officer for no good reason. However, my brother thought it wise to pursue justice on his behalf. I congratulate him for doing that. He will go far and no one will stop him. Going forward, the police will no longer act with impunity once we ensure that justice has been achieved for this young man. Madam Temporary Speaker, Kayole Region happens to be home to many immigrants from Murang’a County. Eighty per cent of the people who live there trace their roots to Murang’a County.   • 5 Mar 2020 in Senate: Madam Temporary Speaker, the Committee on Justice, Legal Affairs and Human Rights is set to visit regions in Nairobi City County that have been affected by this problem. It is also planning to meet the Attorney-General, the Chairperson and Members of the National Police Service Commission (NPSC) and visit other places, for example, Garissa, Kisumu, Eldoret and Nyeri. He made some contributions which I would like to correct from where I sit. Number one, he suggested that the Mover should amend the Bill and provide for the concept of retrospectivity on the account that if you do not have such kind of a Clause, those who corrupted prior to 2020, will not be punished.   • 3 Mar 2020 in Senate: this Bill is proposing to expand the scope of the functions of those bodies which have been mentioned in the proposed Clause 5. My brother from Makueni County has raised the issues that the Director of Public Prosecutions (DPP) ought not to have any interest in this matter. He thinks that the DPP has a vested interest in a criminal prosecution and, therefore, he is not the one who can negotiate with a suspect for what is called deferred prosecution. I beg to disagree. I affirm that indeed, I, Irungu Kang’ata and Mr. Charles Njenga, have had a long pecuniary relationship in the firm of Muchoki, Kang’ata and Njenga. However, in respect to this matter, we have met, and I hereby declare that I do not have any pecuniary interest in this matter.
