It received a comprehensive brief from the Legal Counsel of the National Assembly pursuant to Article 118(1)(b) of the Constitution on public participation and Section 8(3) of the Treaty Making and Ratification Act of 2012. Hon. Temporary Deputy Speaker, the dissenting view that Hon. Wamalwa is raising is clarified in the minutes of the meeting. I guess Hon. (Eng.) Gumbo already knows the Report we are adopting, namely, the Report of the Departmental Committee on Defence and Foreign Relations regarding the defence agreement between Kenya and the United Kingdom of Great Britain and Northern Ireland. Under the Treaty Making and Ratification Act, it is very clear that there are only two options available for this august House, either to ratify or not. Let us put that to rest.

The Defence Cooperation Agreement does not propose any amendments to our Constitution. This is most welcome because that would have been a very steep hill to climb. In terms of national security interests, the Defence Cooperation Agreement provides for joint training and exchange of experience and intelligence.
