  • 30 Aug 2016 in National Assembly: Hon. Temporary Deputy Chairlady, I support this amendment. Many people are afraid of paying taxes particularly if they have overpaid. If they are assured that they will be paid within two years, and that if the payment is delayed, then they will get some interest on it that is a good way to go. This is because it works both ways. Temporary Deputy Chairlady, I wanted to seek a further clarification because it did sound to me that what we are dealing with, as the Chairman was saying, that because it is difficult to get these identification documents, tax cannot be withheld. This gives me the impression that it is possible to get away with it. It is not clear whether we have another provision in the Bill that ensures that the tax that was not withheld is taxed elsewhere. I need that clarification before I support it. view

However, we noted that there were issues where support is given to foreign countries. Has that been taken care of here so that, even if you support a team in London, that does not lead to your tax evasion in this country? That is what will help the country. On one hand, there is the benefit that seems to accrue to our farmers while on the other hand, we seem to be going against the Constitution. To help members move forward, there is need for guidance on that issue of the constitutionality of the new clause. view
  • 30 Aug 2016 in National Assembly: Hon. Temporary Deputy Chairlady, I do tend to agree with what the Leader of the Majority Party and the Hon. Member have just said. It seems we are basing the fact that this is not constitutional because of a law that existed before. If that law at that time was unconstitutional and had not been challenged, that does not make it constitutional. What is being contested is the power that is being given to the Cabinet Secretary.
