I know you must have been a member of many court users’ committee. It is commendable that we have in Clauses 9 and 10 clearly set out procedures of the court, including the calendar of the court. The flexibility that the court can sit anywhere, so long as the appropriate conditions have been met, improves that flexibility and is important, particularly when we have circuits; judges cannot say that they cannot go to this place. So long as there is a place that is appropriate, Kenyans will get justice.

Setting out divisions to look at the areas of law enhances the competence with which people receive services. I am particularly concerned and impressed with having a family division, children’s division and a constitutional and human rights division. The family and children’s divisions to me are such an important division. There are so many issues in this country. Many families cannot go to court to resolve issues by getting quality judgment. If we have divisions that specifically deal with family issues, we will develop appropriate competences. We need the Constitutional and Human Rights Division because of our Constitution. A lot ...

Thank you, Hon. Speaker for giving me this opportunity to make a contribution. The most important thing about this Bill is bringing justice close to the people. For once, I see in this Bill that most issues that confront people in rural areas will be undertaken close to them. This Bill clearly gives the pecuniary limits of what can be undertaken at different levels. As I heard Hon. Kaluma saying, there will be need to increase this. That way, more people will be covered. Hon. Speaker, Hon. Kaluma himself while he was here made the same jest. I will take note of Hon. Obura’s concern but it is in the context in which Hon Kaluma himself made the statement. In civil rights, the number of Kenyans who get detained well beyond the constitutional provisions and leave custody of the police and nothing happens is amazing. okay while the Constitution is quite clear on that. Bringing this in is extremely important. If you look at the number of people who are employed under very unclear labour terms and are shed of easily, you will find that it is very high. They just complain and they cannot be heard because the courts that deal with labour disputes are not near. Therefore, making this available in the Magistrates’ Courts is extremely important in this Bill.
