  • 9 Jun 2011 in National Assembly: Mr. Deputy Speaker, Sir, I had started by making a confession that, initially, I had those misgivings. But I have since then seen that in the presentation of the Budget Speech, there was concern about the plight of the Kenyan people. That is what I started with. But I know you enjoy seeing me talk and so on. Mr. Deputy Speaker, Sir, I was just making the point that we have one year or even less, depending on when we are going to have elections. We are living on borrowed time. In this one year or so, let us be ... view
  • 7 Jun 2011 in National Assembly: Mr. Deputy Speaker, Sir, I similarly want to thank the Minister for Justice, National Cohesion and Constitutional Affairs for the work he has done in successfully piloting this Bill through the stages and also doing a lot of preparatory work that goes to demonstrate the spirit and the passion that he has had in the whole process of reforming the Judiciary. I would want to urge him to continue on that road, but remember that we are always there to assist when it is necessary. You will remember there used to be the old Court of Appeal of East Africa ... view

  • 31 May 2011 in National Assembly: Mr. Speaker, Sir, I will be very brief. As far as I am concerned, we are in a new constitutional order and the test is; are we living by the dictates of the current Constitution or not? I think that is the fundamental question. We cannot go out there hunting for answers to what is provided in the current Constitution. My reading of this Constitution, particularly of the Sixth Schedule--- The Sixth Schedule is the only mechanism for moving from the old Constitution to the current Constitution. You cannot try to move from the old Constitution to the new Constitution ... view

  • 31 May 2011 in National Assembly: Mr. Speaker, Sir, I am very grateful for that point of order but I think what is possible is that the Government and the Minister responsible must show compliance with the Constitution first. If he wants latitude to be provided for him to give a speech, I mean there are mechanisms. He can say: “I want to make a Ministerial Statement”, because it is not a matter that falls within the Standing Orders or the Constitution, as read within the context of the new constitutional order. So, I would plead with my colleagues, and this thing is not just in ... view
  • 31 May 2011 in National Assembly: Mr. Chairman, Sir, I also want to oppose the deletion. I want to oppose it by looking at the other Commissions. view
  • 31 May 2011 in National Assembly: If what my learned friend is saying holds, then we will have a lot of problems with the other Commissions. For example, there is the National Police Service Commission (NPSC). If the NPSC were now to take upon themselves to execute the functions of the Inspector-General, then I do not know what type of police force we will have. There must be a delineation of the responsibility of that NPSC and the Inspector- General and the two deputies that they have. view
  • 31 May 2011 in National Assembly: There is the Parliamentary Service Commission (PSC). We have a Commission for this Parliament. But when it comes to the day to day running of Parliament, then the Office of the Clerk has responsibilities, which are spelt out in the Commission. Take any other Commission such as the Judicial Service Commission (JSC). The judicial authority vests in the Judiciary, which consists of the courts and so on. However, Registrars have certain powers, which are clearly spelt out in the Commission. There is also the National Land Commission (NLC). So, it would defeat the purpose of the Constitution, if instead of ... view
