  • 24 Jun 2020 in Senate: We do not want to hear any more stories out there because governors also speak loudly about us and our Committees. The Committee that they talk a lot about is the County Public Accounts and Investments Committee. I hope that they will rise to the occasion, but also keep the good work that was partly done by the previous Committee, of being current with the audit responsibilities that they have. Thank you, Madam Deputy Speaker. view
  • 24 Jun 2020 in Senate: Thank you, Madam Deputy Speaker. I beg to second. As you know, Standing Committees are really important. Knowing that there is not much to be said about this, since the House is generally in agreement, I was hoping I could use the Floor to implore the Membership of the Committee on Finance and Budget, if at all this Motion goes through, to quickly have a meeting in preparation for the Kamukunji tomorrow. This is because there is pending business on the question of the formula, Division of Revenue Act (DORA) and County Allocation of Revenue Act (CARA) that needs to ... view

  • 23 Jun 2020 in Senate: Thank you, Mr. Speaker, Sir, I also join to support this Petition. Mr. Speaker, Sir, the land question in Kenya has been a very difficult and controversial question. The enactment of the Constitution was supposed to resolve some of these burning questions in relation to land. Of particular concern, were areas in the northern part of Kenya where land tenure cannot be on the basis of the kind of single title or individual title tenure that we have in the rest of the country. In the northern parts of Kenya, there are a lot of considerations that must be put ... view
  • 23 Jun 2020 in Senate: Madam, Temporary Speaker, I am a Member of this Committee but we cannot treat the Business of the House anyhow. When something appears in the Order Paper, there must be a basis or justification to withdraw it or rearrange it. This Motion relates to a constitutional commission. Therefore, it will be highly irregular knowing how people are behaving elsewhere when it comes to issues of dealing with constitutional processes. We are involved in a constitutional process. This is what we are required to do under the Constitution and that is to establish the commission. In fact, other commissions are established ... view
  • 23 Jun 2020 in Senate: Madam, Temporary Speaker, I am sorry that I am coming back to the Floor. I want to point out the importance of this particular Motion. This is a Motion under Part XIII, which are designated as special Motions. So, it is not an ordinary Motion, but a special Motion. The Special Motions are defined in Standing Order 69 (1) (a). It says: “For purposes of this Part, a Special Motion is one— (a) that seeks a resolution of the Senate to approve an appointment or re- appointment in accordance with Part XIV ( Approval of public appointments ); view
  • 23 Jun 2020 in Senate: An office in the Parliamentary Service Commission (PSC) is s public appointment. Madam Temporary Speaker, if you look at Part XIV, which is found on page 51, from Standing Order 70 to 71 on the committal to committees, these decisions are time bound. We cannot sit on it. If you look at it, from when the Clerk receives it, in 7 days or 14 days the matter should be over. For this reason, I continue to urge that we need to get this matter out of the Order Paper by making a resolution. view
  • 23 Jun 2020 in Senate: Madam Temporary Speaker, I beg to second the Motion. Just as we went to the previous Order, you had indicated the many Orders that were put aside in order to enable us deal with that particular Order and Motion relating to the adoption of the report of the Standing Committee on Justice, Legal Affairs and Human Rights for appointment of Commissioner to the PSC. As a result of that, nearly five to six Orders were skipped for good reason. From Order No. 18 onwards again, there are several other businesses that we did not deal with. There is a lot ... view
  • 16 Jun 2020 in Senate: Mr. Speaker, Sir, I just heard what the distinguished Senator for Elgeyo-Marakwet County has said. However, there is always a very important Standing Order; that is, Standing Order No.1. It states - (1) In all cases where matters are not expressly provided for by the Standing Orders or by other Orders of the Senate, any procedural question shall be decided by the Speaker. (2) The decisions made in paragraph (1) shall be based on the Constitution of Kenya, statute law and the usages, forms, precedents, customs, procedures and traditions of the Parliament of Kenya and other jurisdictions to the extent ... view
