Temporary Deputy Chairman, I beg to move:- THAT, Clause 49 of the Bill be amended in sub-clause (6) by deleting the words “of not less than ten million or to a term of imprisonment of not less than ten years or both” and substituting therefor the words “not exceeding ten million shillings or to imprisonment for a term not exceeding ten years or to both”. This is to align the provisions with the sentencing guidelines by setting the ceiling for the penalties. view

If you prescribe a minimum of Kshs10 million in the law, when those people are taken to court for violation of the same law, the courts will have authority to charge them any amount, for example, Kshs1 billion or Kshs2 billion.
