Hon. Temporary Deputy Chairlady, I beg to move:- THAT, Clause 237 of the Bill be amended— (a) by deleting the word “Authority” wherever it appears and substituting therefor the word “Commission; (b) by deleting the words “of not less than one hundred thousand shillings or to a term of imprisonment of not less than six months or to both” and substituting therefor the words “not exceeding ten million shillings or imprisonment for a term not exceeding five years or to both”.

The first part of the amendment redefines the Energy Regulatory Authority. This part of the amendment seeks to enhance the penalty for a person who makes a false statement to the Cabinet Secretary or the Energy Regulatory Commission. Clause 237(b) of the Bill provides for a penalty of not less than one hundred thousand shillings. The words “not less than” mean infinity. Therefore, we are replacing the penalty with a penalty ‘not exceeding ten million shillings or imprisonment for a term not exceeding five years or both.’

Hon. Temporary Deputy Chairlady, the amendment seeks to realign the clause with the State Corporations Act, which places the Chief Executive Officer (CEO) as a member of the board and the one responsible for the day-today management of the organisation but not the Executive Director. The amendment also seeks to refine the Institute of Nuclear Power, Energy and Petroleum as an Agency, in line with the practice of International Atomic Energy Agency.
