  • 8 Aug 2019 in National Assembly: There has been an argument that when a proposal comes from the Commission on Revenue Allocation (CRA) it should be final. The Senate is forgetting that every five years, it determines the formula for sharing revenue among the counties. In Article 217, before the Senate makes that determination, it has to request and consider the recommendations from CRA. It recently got the recommendation, but it has not passed the proposed formula because Senators disagreed on it. We have shops, swimming pools and many others that are shared jointly. When this Bill becomes law, it will provide clear mechanism on how to own a unit within a building and also go a step further to regulate how the common services can be managed by forming a corporation, which will manage and run the services that are jointly owned. At the moment, for example if a building has 20 units of apartments, the payment of rates and rents will be done jointly. There is only payment of rates and rents as one unit. The 20 owners of various units will be contributing proportionately to what they own, but ensuring that that money is paid. This becomes the responsibility of the person who holds the mother title.
