  • 19 Nov 2015 in National Assembly: Thank you, Hon. Temporary Deputy Speaker, for giving me the opportunity to contribute to this Bill by my good friend, Hon. (Ms.) Nyokabi. I want to join my colleagues in congratulating her for looking at the Bill of Rights, which is in Chapter IV of the Constitution, and coming up with a legislation that will help us actualise Article 35 of the Constitution – access to Information. After the enactment of the 2010 Constitution, I was sent to Malawi by the then Speaker of the National Assembly, Hon. Kenneth Otiato Marende, to represent him in a forum. As we were ... view
  • 19 Nov 2015 in National Assembly: be understood that we seek information in trust. We do it based on delegated power by the people of Kenya. If Kenyans need information, they should get it. Hon. Temporary Deputy Speaker, there are so many good provisions in this Bill. I do not want to go to the details because this Bill is literally allowing us to access information. There are instances where it has been very difficult to access information. The Waki Commission Report, which we debated the other day, is an example. It is a shame that we took several hours in this House debating whether a ... view
  • 19 Nov 2015 in National Assembly: Hon. Temporary Deputy Speaker, we need to be very clear on this particular clause. We probably need to give it more beef to clarify this exemption. Otherwise we may end up, possibly, The electronic version of the Official Hansard Report is for information purposesonly. • 19 Nov 2015 in National Assembly: I also wanted to talk briefly on Clause 11. We need to critically look at Clause 11. For me, if we are making access to information mandatory, that it is the norm and not the exception, then once someone applies for information to be provided and there is an officer who wants to deny that information, then that officer should bear the responsibility. It should not be a decision of an officer to choose whether to provide information or not. To me, if you are refusing to provide information, you should actually--- We need even to put it that, that ... view
  • 19 Nov 2015 in National Assembly: I can see my time is over but I want to thank Hon. Nyokabi. This is very progressive and I would urge other Members to take up this Chapter on the Bill of Rights and bring more legislation to actualise it. view

  • 12 Nov 2015 in National Assembly: Thank you, Hon. Speaker. Indeed, the matter before us is weighty. Unlike the four speakers who have spoken ahead of me, I have the benefit of being an old Member of PAC. I have sat in the PAC all through from the time we started looking at this issue of the Judiciary to date. So, I have the benefit of history. The most important determination and intervention we ask from you is whether Parliament, through its Committees, can summon the CJ. Actually, that is the elephant in the room. I respect the CJ of the Republic of Kenya and I ... view
  • 12 Nov 2015 in National Assembly: “Either House of Parliament, and any of its committees, has power to summon any person to appear before it for the purpose of giving evidence or providing information”. Hon. Speaker, the elephant in the room is whether this “any person” includes the heads of the arms of Government and that does not include the CJ. I am not trying to scare you, Hon. Speaker because I know you know very well that while sitting as the Chairman of the PSC, you must exercise prudence and clear financial management. As you make this ruling, you should also consider that one time ... view
