  • 26 Aug 2015 in National Assembly: The Constitution allows the Media and the public to participate in Parliamentary proceedings and they can only be restricted under exceptional circumstances. This would have prohibited coverage of Parliament unless allowed to do so. With those many remarks, I am happy to support this Bill. We will amend the provisions in Clauses 27, 33, 34, 35 and 36 which provide that the Clerk, an employee of Parliament, can report a Member to the Director of Public Prosecutions (DPP) for prosecution. view

  • 20 Aug 2015 in National Assembly: difficulty supporting the proposed amendment to Article 165 which is provided in Clause 3 of this amendment. My difficulty is with regard to trying to solve a problem which, to me, is administrative through a serious legislation, or through an amendment to the supreme law of the country. When the people of Kenya voted for the Constitution, the understanding was that the three arms of the Government would exercise their functions and responsibilities with respect, caution and maturity.   • 20 Aug 2015 in National Assembly: If we say that we have to wait for the Executive to conclude whatever it is doing, then it means that this Parliament will not even interrogate and investigate for example a procurement process that is ongoing and I do not think that will be very good for this country. At times, even though the three arms are independent, Parliament is supposed to check the Executive and in the same token, somehow silently this Constitution gives the Judiciary the power to also check both the Executive and the Legislature. First of all, it should be noted that to constitute all commissions, you have specific and special selection panels and the procedure does not involve the PSC. In fact, if you go to the IEBC, you will find that there is a selection panel and when you go to the Judicial Service Commission (JSC), you find that there is a procedure set out in law which is separate and distinct. Remember we are debating both the President’s reservations and the proposed additional amendment by the Committee together. I know we may not get the two-third majority, but it should go on record that what the President has recommended is fatally wrong in law and practice of this country. The Nominated Member of Parliament who is a very good friend of mine wanted to mislead this House that if one would be dissatisfied by this process, one would go to sue the PSC and yet she knows that the appointing authority will not be the PSC. It will just be making recommendations. Therefore, if one is dissatisfied, then you sue the appointing authority. These others are working at the behest of the PSC. You cannot sue the PSC. view
