  • 26 Feb 2015 in National Assembly: Whichever the problems we may be having with those private companies, to me the best way to go is to have commercialisation of sugar production by private hands. As we move towards privatisation, I agree with my colleagues especially those who have opposed this Report and more particularly hon. Nyikal, hon. Jared K’Opiyo and Kobado. I also listened to hon. Onyango K’Oyoo who painfully argued like one who really represents sugar farmers. I agree that something drastic needs to be done if we are going to privatise these sugar factories.   • 26 Feb 2015 in National Assembly: fundraising in my place, it is immoral even on my part as the representative of the farmers. One thing that I also would not like to see, and with all due respect to other colleagues of mine who come from probably some parts of this country I may mention, is a situation where after selling these factories, they are relocated, the sugarcane is grown in Nyanza or in Western and transported all the way to another section of this country, say Central. I also wanted to speak on Clause 20 of this Bill with concerns budgets. We all know that for any auditor to be independent, function independently and do his work without any interference or intimidation, their budget needs to be cushioned. We need to ring-fence the Auditor-General’s budget and only subject it to the people’s representatives, and that is Parliament.   • 17 Feb 2015 in National Assembly: Clause 31 on the certification of audit processes, I see that Clause 31(1)(c) reads:- “at the conclusion of audit examination of the financial statements of each State Organ, an exit meeting shall be held at which the Auditor- General shall submit a draft management letter which shall include findings and recommendations to the accounting officer and comments of the accounting officer on the Auditor-General’s findings and recommendations and the Auditor-General shall provide a copy of the report to the substantive head of that entity, if different from the accounting officer and, the Chairperson of the governing body, where applicable.” This ... view
  • 17 Feb 2015 in National Assembly: I have an issue with “a draft management letter.” A management letter is a letter on internal weakness which the auditor does to the accounting officer recommending what changes need to be done. I do not understand why we should legislate for a draft. We need to say: “The Auditor-General shall submit a management letter to the accounting officer.” Whatever the accounting officer does with that letter then becomes an issue for them. I want to straightaway take you to Article 118 of the Constitution. Article 118(2) says:- “Parliament may not exclude the public, or any media from any sitting unless in exceptional circumstances the relevant speaker has determined that there are justifiable reasons for the exclusion”.
