  • 20 Nov 2013 in National Assembly: Hon. Temporary Deputy Speaker, Sir, from the Chair of the Committee, I got it that apart from dealing with the issues of Turkana, he will address the insecurity affecting fishermen in Lake Victoria, at the Coast and all the other places in Kenya where fishing is an economic activity. I wanted the Chair to be realistic about the two weeks period. If it is only to deal with the Turkana issue which is probably a new issue, it is practical. However, on the issue of Lake Victoria, it is not practical for the Chairman to handle it in two weeks’ ... view
  • 20 Nov 2013 in National Assembly: On a point of order, hon. Temporary Deputy Speaker, Sir. We are referring to Private Members’ Motion as spelt out under Standing Order No.40. It talks of business that shall be disposed of on Wednesday morning. I would like hon. Serut to pay attention. It says:- “A Bill or a Motion not sponsored by the Majority or Minority Party or a Member belonging to the Majority or the Minority party or by a Committee, shall have precedence over all other business and such other as the House Business Committee shall ballot” Therefore, the fact that I brought a Motion or ... view

  • 20 Nov 2013 in National Assembly: On a point of order, Hon. Speaker, Sir. Hon. Kigo has just repeated what other Members have said before, that Mr. Mututho is innocent until proved guilty. I want to ask whether the hon. Member is in order when the Anti-Corruption and Economic Crimes Act is very clear. This is what this Act says under Section 6(2). It says:- view
  • 20 Nov 2013 in National Assembly: “A public officer who is charged with corruption or economic crime shall be suspended at half pay with effect from the date of the charge. A suspended officer who is on half pay shall continue to receive the full amount of any allowance.” view
  • 20 Nov 2013 in National Assembly: I also want to be on record as saying that hon. Mututho is my friend but as former President Moi once said about the late George Saitoti, friendship is different--- Are we going to appoint Mututho and then suspend him immediately on half pay? Could I get a clarification based on this provision of the law, or are we going to amend the law as hon. Dalmas said? This is because the law requires that if you are charged in court, you are supposed to be suspended on half pay. Could someone clarify to me that? view
  • 19 Nov 2013 in National Assembly: Thank you, hon. Deputy Speaker. Pursuant to Standing Order 44(2)(c) I wish to request a Statement from the Leader of Majority Party regarding the impending rationalization of State Corporations and Parastatals through a taskforce appointed by the President. The Executive is in the process of restructuring the existing State corporations which inevitably will result in some being dissolved or merged for efficiency, effectiveness and cost saving. The taskforce was mandated to undertake an analysis, and has reportedly completed the same and forwarded a report to the President for action. The President has publicly stated that he intends to act on ... view

  • 19 Nov 2013 in National Assembly: (i) whether the rationalisation, especially if it results in dissolution of some State corporations will be done within the provisions of Sections 26, 27 and 28 of Part V and VI of the State Corporations Act, Cap.446; (ii) whether the process will be done in accordance with the provisions of Section 44 of the Public Finance Management Act (PFM) with regard to the role of Parliament in the process of declaring a State corporation dissolved; and (iii) finally, whether the process will reflect the provisions of Section 6(g) of the PFM Act, which makes the Public Finance Management Act prevail ... view
  • 19 Nov 2013 in National Assembly: On a point of order, hon. Deputy Speaker. My point of order is with regard to your directive. You made a ruling sometimes back about the appointment of the Chief of Staff and Head of Public Service. This was referred to the Committee on Justice and Legal Affairs. We need to get an indication as to when this matter will be brought to the House. view
