The Minister for Justice, National Cohesion and Constitutional Affairs argued a lot about the First Schedule to the Act and Section 3(2). He based his argument on that, because that Schedule is silent about consulting Parliament and getting recommendations from the Board; then the President has the express authority to go ahead and make the appointments. This is because in the Fifth, Sixth, Ninth, Tenth and Thirteenth Reports of Public Investments Committee (PIC), the same Minister was mentioned and was supposed to be a subject of investigation by the KACC. Could I know why the Minister is answering this question and yet he has not declared his interest? Further, is this question not arranged to pre-empt the Chair’s ruling to be done tomorrow? view
