Thank you, Hon. Temporary Deputy Speaker. From the outset, I oppose the guarantee to the KPA from the Government to borrow this money. We have been told that what the port requires is a guarantee from the Government to expand the port for the future and not now. This is a need for the future. If the port has a lot of money that is not being used, it should be brought to the Treasury as revenue and it can be used for other urgent projects such as roads. This House seeks to give the Government an approval to give guarantee to the port, but my concern is how the public debt is. Are we able to service it comfortably? The answer is no. There has been public outcry that the public debt keeps going up day in, day out. Despite the interest rate that they are giving us, I feel that the issue of giving guarantee by the Government should not take place now. Let me join the queue to thank my colleagues in the Departmental Committee on Labour and Social Welfare for working tirelessly for two hours to ensure that this Bill comes out to be what WADA wanted. I also want to thank our colleagues in the House for accepting the position of the Committee together with that of the Executive that we pass this Bill with the amendments that have been brought without further amendments. Hon. Temporary Deputy Chairlady, I want to persuade my colleagues that the argument advanced by Mheshimiwa Kamoti seems to hold water. There is no constitutional office that can oversee another constitutional institution. Please, Members, let us not create a situation where some people will rush to court to contest this legislation. I want to specifically speak to Clause 22 (a) which seeks to delete sub-section (2) of Section 39 of the Land Registration Act and substitute with a new sub-section which says: “No certificate shall be required under subsection (1) if the instrument relates to a sublease where the lease is by virtue of any law subject to full payment of the rent by the head-lessor.” The certificate they are making reference to here is a certificate in terms of payment of rent by the head-lessor.
