Mr. Temporary Deputy Chairman, Sir, I rise to oppose the amendment. The functions that have been bestowed upon this Commission are functions which will be carried out throughout the year. The moment we start saying that the Commissioners will serve on part-time basis, they will not be able to fulfill these particular functions.

Mr. Temporary Deputy Chairman, I think we are basically discussing a Commission that was set up even without a law in place. The Government has already seconded some staff to it. But basically, as we move forward, and since we are putting down the law now, we are saying, as a matter of checks and balances between the Treasury, the Revenue Allocation Commission and all the other organs that will be handling our financial management, that the Commission is given the leeway to recruit its own staff and make its own decisions independently.

Madam Temporary Deputy Speaker, I also join to support this essential Bill. I totally agree with Mr. Kamama that basically this House should not have appointed the Chairman and the Commissioners of the Revenue Allocation Commission before the Bill came here. I think this is a mistake that we will learn from so that we can always know how to put the horse before the cart.

I want to make one comment relating to Clause 4 which reads:- “The headquarters of the Commission shall be in the capital city but the Commission may establish branches at any places in Kenya.”

I am more interested in the second part of that Clause “at any places in Kenya” and relating this to the functions that have been provided by the Constitution to this Commission. I want to make reference to Article 216(2) which provides that the Commission shall also make recommendations on other matters concerning the financing of and financial management by county governments as required by this Constitution and national legislation. Article 216(4) says that the Commission shall determine, publish and regularly review a policy in which it sets out the criteria by which to identify the marginalized areas for purposes ...

Mr. Temporary Deputy Speaker, I would like to comment on the recall Clause. As hon. Kamama has said, let us raise the bar, so that people do not misuse it. Let us put it at 50 per cent. Lastly, on nomination of candidates, the Bill proposes post-secondary school qualifications for all electoral positions, but can we clarify this further and have separate qualifications for parliamentary candidates, presidential candidates and governorship candidates?
