Thank you, Hon. Temporary Deputy Chairlady. I thank those Members who are saying “zero”. I rise to oppose. Just before we vote, I want Members to know what they are voting for. I want to refer you to the Value Added Tax Act, Section 5, which states that the rate of taxation shall be zero per cent or 16 per cent. Section 6 gives the Cabinet Secretary (CS) powers to amend the rate of tax even through a Gazette Notice, if a value or percentage has been added to it. What does it mean? It means that if today we ...

Hon. Speaker, I may have lost my voice, but I will try to address you in the best way. With a lot of respect, Hon. Speaker, when we went into Committee, Clause 18 was called by the Chairperson and Members made representations and a vote was called according to the Standing Orders.

Just a minute. Just give me time. I will get there. A voice vote was called and the Chair pronounced herself very clearly that, “The Noes have it.” When we began, the Chair had satisfied herself that we were more than 232 in the House. So, after the voice call voting was done, Hon. Duale, Member for Garissa Township, led a drove of people, including my brother - a person I respect, my friend. We were 304. I have not called anybody. We were 234 when Hon. Duale led a horde of people away. All of them went. Hon. Speaker, ...

Hon. Speaker, protect me from the Leader of the Minority Party. As you see, I am sitting next to him. The Leader of the Minority Party is threatening me with consequences for participating in this House pursuant to Article 117, which states that there is freedom of speech in this House, and that everybody will follow his conscience as we transact business in this House. He is talking about issues which are outside of this Parliament. It is the same thing which the Leader of the Majority Party, in a way, is trying to cast aspersions on by telling us ...

No, I am very happy and settled this morning. The Chair has explained something but I will ask him to listen to us. We understand what you have done, but the way you have drafted your law will not do what you want to achieve. In sub- section 1, you very well say that Central Bank may prescribe. That is the way legislation is done, because it is “may”. They may choose to do it or they may also choose not to do it. But when you go to sub-section 2 and then you say that Central Bank shall prescribe ...

should have said: “Within coming into force of these regulations, the regulations should be done within 31 days. This is a different ball game. The way you have done it, the understanding is that if they do not do it within 30 days, they will not do those regulations at all. So, you can get help from the Table to do a further amendment and get your wording correctly, so that you do what you mean.

Hon. Temporary Deputy Chairman, we are in problems now. We have a committee that touches things that they know very little about. I am sorry. Something called limitation of actions has nothing to do with minors. It has everything to do with the period that the action is alive. Minors have somebody called guardian ad litem (GAL). Minors have somebody called a ward. I do not think this committee had legal advice. What they are trying to do here, and they are not telling you Members, is that KRA will chase you not only for the six years but for ...
