  • 5 Sep 2013 in National Assembly: Lastly, even granted that the Speaker allowed this, I am thinking about the content of the Motion that my colleague hon. A.B. Duale is about to present. The content of that Motion must be such as to be in the realm of urgent issues of national importance, which is comparable to issues you see in Standing Order No.33; these are urgent issues of national importance; again, these require the Speaker’s concurrence. If we debate this Motion, the question will be what happens to it? In my respectful submission under Standing Orders No.33, this is one of those Motions which the ... view

  • 5 Sep 2013 in National Assembly: Thank you hon. Speaker, Sir. I rise to contribute and oppose the Motion which is before the National Assembly. Just as my colleague hon. Kabando wa Kabando has said, it is good that we should approach this matter as National Assembly, in a bi-partisan manner and contribute as though we are delegates of the whole National Assembly today to discuss an issue that is so important. Hon. Speaker, Sir, statements have come of course from the Leader of Majority Party. But I know that he has a knack of sparking polarized debates. I refuse to get into a debate that ... view
  • 5 Sep 2013 in National Assembly: with the Constitution. It means that the whole of this Motion is because of President Uhuru and his Deputy William Ruto. Hon. Speaker, Sir, I participated in campaigning for this Constitution. I voted in the referendum for this Constitution and I am very proud that this Constitution was promulgated. Those who have been in the trenches in the reform movement know that why we love the new Constitution is because we knew we would come to the country that will not matter who is the President of Kenya or the Deputy President so long as everybody in all our 42 ... view
  • 5 Sep 2013 in National Assembly: Thank you, hon. Speaker. One thing I know is that I am nobody’s sycophant. As far as I can remember, these two people were charged before this court before they became President and Deputy President. It might be so easy to cut-call, to boo and to support, but I will be very much willing to discuss with those men and women who are ready to talk about facts, the law, the Constitution and things that this country wants to be addressed. Hon. Speaker, Sir, I want to conclude because I want to give time for others to contribute. Why are ... view
  • 6 Aug 2013 in National Assembly: Hon. Temporary Deputy Speaker, something is still bothering me. Did you hear the Member for Nairobi County claim that there are papers being circulated in the House? Could we know what kind of papers they are? If they are love letters, are they being circulated amongst hon. Members to the right side of the Chair only? Could we also have them circulated to hon. Members to the left side of the Chair? What are the letters being circulated in the House for? view
  • 6 Aug 2013 in National Assembly: Thank you, hon. Temporary Deputy Chairlady. The amendments sought by my learned friend, hon. Nyokabi, are sound; the only thing is that because they are punitive in nature, there is need for further clarity. For example, what is “staff”? The word “staff” should have been defined either in the interpretation section, or you could still define it within the meaning of this section. If you do not get it clear, its ambiguity may bring a problem in criminal proceedings. Two, the Commissioner should also be part of the staff. If I am counsel representing the Commissioner, I can really find ... view
  • 6 Aug 2013 in National Assembly: Thank you, hon. (Ms.) Temporary Deputy Chairlady. I seek the indulgence of the House to move an amendment to the New Clause 59B in the following terms:- view
  • 6 Aug 2013 in National Assembly: THAT, the New Clause 59B be amended by deleting the words, “one million” appearing in paragraph (d) after the word “exceeding” and substituting therefor the words “one million five hundred thousand”. view
  • 6 Aug 2013 in National Assembly: Thank you, hon. Temporary Deputy Chairlady. Yes, that is the gist of the amendment. Just to show hon. Members this will increase the penalty that a member of staff of the authority will be fined; it is a little bit more serious than the sanction against the members of the public. It is in good sense because members of the authority are expected to be a little keener in doing their work under the Act rather than members of the general public. view
