Chepkonga is correct in the sense that the Constitution has fixed the presumption of guilty, but I think he needs to couch his amendment properly. If the amendment says “in any proceedings” then you still do not get where you want to go. I think what he is talking about is “civil proceedings arising out of this Act”. I think he needs to couch it that way because only criminal proceedings are underpinned by the Constitution. Temporary Deputy Chairlady, on behalf and with the consent of the Member for Westlands, I beg to move:- THAT, the First Schedule be amended in Part B by inserting the following new item immediately after item 27- (1) Subject to paragraphs (2) and (3), materials, articles and equipment, including motor vehicles, which— (a) are specially designed for the sole use by disabled, blind and physically handicapped persons;
