Ong’era in order to suggest that this Committee should never care to find out whether the allegations against the IEBC are true or not? Is she in order to suggest that this Committee should simply condemn the IEBC unheard and regardless? view
  • 5 Jul 2016 in Senate: (Sen. (Prof.) Kindiki): Mr. Temporary Speaker, Sir, I am sorry to interrupt Sen. Ong’era. I like the last part where she says that is her opinion which should have settled the whole issue. However, in my view, for clarity, the Senator should be directed by the Chair to clarify that there is no hierarchy of mandate. This mandate is all inclusive and in fact, (d) depends on the findings in (a). view

  • 30 Jun 2016 in Senate: (Sen. (Prof.) Kindiki): Mr. Temporary Speaker, Sir, allow me to congratulate the Speaker for a very well-reasoned and justified communication. I want to say over and above what the Speaker has clearly stated, Section 30(3) of the County Governments Act talks about things to do with accountability for all resources in the county; human resources and financial resources. That responsibility is on the governor of the county and not any other officer. Mr. Temporary Speaker, Sir, for that reason, the governor of a county cannot abdicate his or her responsibility and pretend to send junior officers when serious issues of ... view

  • 30 Jun 2016 in Senate: (Sen. (Prof.) Kindiki): Mr. Temporary Speaker, Sir, I know that the Senate Minority Leader has great interest in this Motion and so are many Kenyans in this country. Mr. Temporary Speaker, Sir, I beg to give notice of the following Motion:- THAT: ACKNOWLEDGING that the sovereign power of the People of Kenya may be exercised directly or indirectly through their democratically elected representatives and that the People’s sovereign power shall be exercised only in accordance with the Constitution; RECOGNIZING that through pronouncements, sections of the Kenyan society have raised issues on the credibility, impartiality, integrity and independence of the Independent ... view
  • 29 Jun 2016 in Senate: (Sen. (Prof.) Kindiki): On a point of order, Mr. Speaker, Sir. I want to congratulate Sen. (Dr.) Khalwale for raising this issue. I also congratulate you for the direction. However, for the record, I wonder whether it is also true that when a Senator speaks for more than the time that they have been allocated, without being interrupted either by the Chair or the timer, then that Senator is speaking with implied permission from the Speaker. Permission can be express, in which you give them more minutes or it can be implied by conduct. We are likely to have a ... view
  • 29 Jun 2016 in Senate: On a point of order, Mr. Speaker, Sir. I would like you to find a re-reading of Standing Order No.225 and give directions. There is a difference between what Sen. Mositet is doing, which is presenting the Petition and what he will do later, when he is allowed to speak to the Petition. In my opinion, Standing Order No.225(3) provides that--- view
