(Sen. (Prof.) Kindiki): I thank you, Mr. Speaker, Sir. I will be brief. First, I wish to applaud you, just as other hon. Senators who have stood here have done. I have listened to your Communication and every argument you have made is backed by provisions of the law. As the Senate, we have made our position very clear. The same clear position has come from both the Majority and Minority sides of this House because we do not believe this is a partisan issue. We agreed that we will stand united for the sake of the country on all ...

Mr. Speaker, Sir, I wish to thank Sen. Orengo for the compliments. This tells the whole world how this House is working in a bipartisan manner. I read in the book 48 Laws of Power ; Law 42 says that:- “Strike the Shepherd and the sheep will scatter.” Article 96(1) of the Constitution gives the Senate a very important responsibility. This Article states:- “The Senate represents the counties, and serves to protect the interests of the counties and their governments.” I used to ask myself the question: “Protect from whom?” I have now known from whom. The counties need to ...

Mr. Speaker, Sir, it is with deep sorrow that I received the news that our President has signed the Bill. Since the Speaker of the National Assembly made it formally, I have no reasons to doubt. Even if there is any doubt, then it can be confirmed in the Kamukunji that is proposed by Sen. Orengo. Mr. Speaker, Sir, as Sen. Orengo and Sen. Wako said – and I agree – we have no business being Senators if we have no business to do with allocation of resources to our counties. Permit me to say this with great humility. I ...

If this be the case, Sen. Haji, somebody somewhere is questioning why you did not run for the position of Member of Parliament somewhere in Mbalambala and instead ran for Senator. He is putting into doubt the fact that you ran in more than four constituencies and saying that you are just a useless appendage. Mr. Speaker, Sir, let us go for this Kamukunji, so that we can say certain things outside the Press. We will be freer. When I walked out, I consulted with the Chair of Council of Governors and there is a feeling that we should meet ...

Mr. Speaker, Sir, I have not had a chance to consult with the Vice-Chair because I was out of the country. However, how does such information get to committee chairs if they are not in the House at a particular time? There must be institutional mechanisms that ensure we get such questions formally, so that we transmit the same to the necessary institutions. Be that as it may, if you allow me, in another one hour, I will consult the Vice-Chair and get the correct position then get back to the House. Sen. Musila thinks tomorrow will be the best ...

Thank you, Mr. Deputy Speaker, Sir, and thank you Sen. Mungai for sparing some minutes for me. I think the subject that is before us is very important and very critical. The declaration of alcohol and drugs as a national disaster is very important in terms of creating the necessary awareness about this issue and also getting the attention of the world, all the departments of the world including, if need be, tax exemptions in certain areas that can help us deal with alcoholism or tax punishments The electronic version of the Senate Hansard Report is for information purposes only. ...

Mr. Speaker, Sir, if you look at what they call Circular No.1, which the President issued in so far as the Department of Devolution is concerned – actually it is what is called the Ministry of Devolution and Planning – you would easily say that the title is misleading, because if you look at the contents of that Ministry, the larger percentage of the Ministry is involved in matters of planning, and planning is a function of national Government. This Ministry is an amalgamation of about six Ministries; first thee is what used to be the Ministry of Planning. So, ...

Mr. Speaker, Sir, first, I really thank my colleagues for the very good questions. There is a misunderstanding in this country and in many countries in the world on matters of devolution. The word “devolution” in the Constitution does not refer to counties. If you read Article 6(3) of the Constitution, you will realise one very important provision. It says that:- “A national State organ shall ensure reasonable access to its services in all parts of the Republic, so far as it is appropriate to do so having regard to the nature of the service.” This refers to a national ...
