Mr. Deputy Speaker, Sir, I want to support the Motion. Kenyans are asking one big question. The Government is quiet about the Constitution. You will recall that those who have been agitating for the New Constitution, particularly in the 8th Parliament, are the ones who are now in Government and they are now very quiet about the new Constitution. I beg to support.

asked the Minister of State for Administration and National Security:- (a) whether he is aware that Mr. Walter Kimutai Ngetich, (P/No.98002868) of the Ministry of Health (NASCOP) mysteriously disappeared on 19th April, 2005 and was subsequently found dead on 21st April, 2005; (b) whether he is further aware that a murder suspect was arrested then released under unexplained circumstances before he was charged in a court of law; and, (c) what he is doing to unearth the truth on the matter.

Mr. Speaker, Sir, the Assistant Minister has said that anybody with information should volunteer it to the police. This is a sign of reluctance on the Government to act on this matter. The Government should look for the suspects and not to wait for people to volunteer information. We want an assurance from the Assistant Minister that the Government will be serious with this matter, carry out investigations and apprehend the suspects.

Mr. Speaker, Sir, this is a case of cover-up because the main suspect who was supposed to be charged, instead reported to the police. He stated in his statement that Mr. Ngetich had gone on official duty to Mombasa when records in the office do not indicate that Mr. Ngetich had been assigned any duty at all in Coast Province or Mombasa. asked the Minister for Finance:- (a) whether he is aware that the Kenya Power and Lighting Company (KPLC) charges Value Added Tax (VAT) on Constituency Development Fund (CDF) electricity projects; and, (b) what he is doing to ensure that such projects are treated like other CDF funded projects.

Mr. Temporary Deputy Speaker, Sir, communities lose a lot of money to the KPLC. For example, when they undertake a project worth Kshs15 million, they pay about Kshs3 million as VAT. Could the Assistant Minister consider granting a waiver to the CDF funded electricity projects? The money which is paid as VAT can be used to build primary schools.

Mr. Deputy Speaker, Sir, apart from Soin Sugar Factory, the projects that the Vice-President and Minister for Home Affairs is talking about are non-existent. Soin Sugar Factory 1636 PARLIAMENTARY DEBATES June 28, 2006 is also a private entity. It is true that the bulldozer from the Authority was used to clear the site, but it was paid for. So, we cannot claim that it was used to assist the people of Kericho. The fish farms that he is talking about are also non-existent. These projects only exist in their books and not on the ground. Mr. Deputy Speaker, Sir, the Vice-President and Minister for Home Affairs has agreed to go and inspect these projects. He has caused more confusion from his answer because Kaproret is not in Kericho. It is actually in Buret, and there is no such project in Kaproret. This June 28, 2006 PARLIAMENTARY DEBATES 1637 Authority has sidelined Kipsigis and Nandi districts because there are no projects which have been undertaken in those districts. Apart from that, the board of directors come from only one area. Since the inception of the Authority, the Managing Directors always come from one community.
